What are the regulations regarding the admission proposal of higher education institutions in Vietnam?
Based on Article 11 of the university and college admission regulations in the field of Early Childhood Education issued together with Circular 08/2022/TT-BGDDT, the admission proposal of higher education institutions is stipulated as follows:
- Training institutions build, publish, and implement the admission proposal to fulfill the accountability and commitment to candidates, state management agencies, and society. The admission proposal must contain sufficient information as a basis for:
+ Candidates to choose schools, fields, training programs, and appropriate admission methods based on their abilities, interests, and personal conditions; prepare the conditions to participate in the selection process and carry out the steps according to the institution's admission plan;
+ State management agencies and society to supervise the implementation of legal regulations and commitments to learners made by the training institution in the admission and training work.
- The main content of the admission proposal includes:
+ Information introducing the training institution, fields, and training programs, including information about the decision to open the field, training language, faculty, learning and research conditions, graduation qualifications, quality accreditation results, the percentage of graduates (out of total admissions) and the percentage of graduates employed in jobs appropriate to their specialization (according to Appendix 3 of the university and college admission regulations in the field of Early Childhood Education issued together with Circular 08/2022/TT-BGDDT) (here);
+ Complete information about training costs, tuition fees, admission service charges, and other service fees for the entire course, each academic year; scholarship policies, tuition fee waivers and reductions, financial support, dormitory accommodation, and other preferential policies and support for learners;
+ Admission plan and scope for admission rounds in the year (in which the first round of regular university and college admissions must fit the overall plan issued by the Ministry of Education and Training), including regulations on admission candidates and conditions, admission methods, selection combinations, and admission quotas for fields and training programs; process and procedures for applying for admission and other necessary information for candidates;
+ Risk handling plans during the deployment of admission work and the commitment responsibilities of the training institution.
- The training institution announces admissions along with the publication of the admission proposal on the institution's electronic information page and other appropriate forms at least 30 days before the first admission round registration; in case of adjustments or supplements (if any), at least 15 days in advance.
What are penalties for higher education institutions for conducting admissions not in accordance with the announced admission proposal?
Based on point b, clause 3, Article 8 of Decree 04/2021/ND-CP, the regulations are as follows:
Violations of admission organization regulations
- Fining from 10,000,000 VND to 20,000,000 VND for any of the following acts:
a) Announcing admissions, publishing the admission proposal incorrectly or insufficiently according to current legal regulations;
b) Announcing admissions not within the time frame prescribed by current legal regulations.
- Fining from 20,000,000 VND to 30,000,000 VND for any of the following acts:
a) Publishing admission quotas exceeding the quantity as per regulations for determining admission quotas;
b) Failing to follow the prescribed admission process as per current legal regulations.
3. Fining from 30,000,000 VND to 40,000,000 VND for any of the following acts:
a) Failing to announce the input quality assurance threshold for fields of study with prescribed quality assurance thresholds;
b) Conducting admissions not in accordance with the announced admission proposal.
- Fining from 40,000,000 VND to 60,000,000 VND for organizing admissions for fields, disciplines, or foreign education programs without permission.
- Additional penalties: Expelling foreigners committing violations specified in clause 4 of this Article.
- Remedial measures: Compulsory transfer of qualified admitted students who have enrolled to other qualified educational institutions that are permitted to operate, or annulment of admission decisions, refund of the collected fees to the students if the transfer cannot be arranged, for violations specified in clause 4 of this Article.
And based on point b, clause 3, Article 3 of Decree 04/2021/ND-CP, the regulations are as follows:

- Fine amounts in the field of education:

b) The fine amounts specified in Chapter II of this Decree apply to administrative violations of organizations, except as provided for in clause 5 of Article 9, clause 2 of Article 11, clause 1 and points a, b, c, d, e of clause 3 of Article 14, point b of clause 3 of Article 21, clause 1 of Article 23, clause 1 of Article 29 of this Decree, which are fine amounts for administrative violations of individuals. The fine amount for individuals for the same administrative violation is half of that for organizations.

Thus, higher education institutions engaging in admissions not in accordance with the announced admission proposal will be fined from 30,000,000 VND to 40,000,000 VND. (This fine amount is for organizations.)
