Who is eligible for the teacher seniority allowance in Vietnam?

According to Article 2 of Decree 77/2021/ND-CP, eligible individuals for the teacher seniority allowance are educators currently teaching and providing education in public educational institutions and academies, schools, centers responsible for training and fostering under state agencies, political organizations, socio-political organizations (commonly referred to as public educational institutions), including:

- Educators include public employees specialized in education and training (with a code starting with V.07) and public employees specialized in vocational education (with a code starting with V.09) who are listed on the payroll approved by the competent authority, currently teaching and educating in public educational institutions funded by the State (including revenue from the state budget and other operational revenues as specified by law) (1).

- Educators listed on the payroll approved by the competent authority, currently teaching, guiding practice, and conducting experiments on training ships, school workshops, stations, farms, practice centers, and laboratories of general education institutions, continuing education institutions, vocational educational institutions, public higher educational institutions (2).

Note: Individuals not falling under categories (1) and (2) but holding codes starting with V.07 and V.09 are not eligible for the teacher seniority allowance.

According to Article 4 of Decree 77/2021/ND-CP, the regulation regarding the level of the teacher seniority allowance is as follows:

Seniority Allowance Level

1. Teachers involved in teaching and educating who have mandatory social insurance contributions for 5 years (60 months) are entitled to a seniority allowance equivalent to 5% of the current salary plus allowance for leadership position and seniority allowance exceeding the frame (if any). From the sixth year onwards, each year (12 full months) adds an additional 1%.

2. The seniority allowance is calculated and paid alongside the monthly salary and is used to calculate social insurance, health insurance, and unemployment insurance contributions.

3. How to calculate the monthly seniority allowance amount:

What are regulations on the period of entitlement and non-entitlement to the seniority allowance in Vietnam?

According to Article 3 of Decree 77/2021/ND-CP, the periods of entitlement and non-entitlement to the seniority allowance for teachers are governed as follows:

- Period of Entitlement to Seniority Allowance

The period of entitlement to seniority allowance is determined by aggregating the following periods:

+ The period of teaching and educating with mandatory social insurance contributions in public educational institutions.

+ The period of teaching and educating with mandatory social insurance contributions in non-public educational institutions (for educators currently teaching and educating in public educational institutions who previously taught and educated at non-public educational institutions).

+ The working period eligible for seniority allowance, including: the period of work with a salary arrangement in one of the titles or positions of customs, court, prosecution, auditing, inspection, civil judgment execution, forestry protection, national reserve, and party inspection; the period eligible for seniority allowance in the military, police, cryptographic work and the period eligible for seniority in other sectors and professions (if any).

+ The period of military service as prescribed by law, provided that before going to military service, the individual was eligible for the professional seniority allowance.

- Period of Non-Entitlement to Seniority Allowance

+ Probation period.

+ Continual unpaid leave period of 01 month or more.

+ Sick leave, maternity leave exceeding the time limit prescribed by the law on social insurance.

+ Period of working as a specialist, studying, interning, working, and surveying domestically and abroad exceeding the period determined by the competent authority.

+ Period of suspension from work or temporary detention or imprisonment in service of investigation, prosecution, trial activities.

+ Other non-working periods as specified under points a, b, c, d, dd clause 2 Article 3 of Decree 77/2021/ND-CP.
