- This regulation governs the organization and operation of primary schools, including: organization and management of the school; organization of educational activities; duties and rights of teachers, staff; duties and rights of students; school property and finances; relationship between the school, family, and society.
- This regulation applies to primary schools, special schools, and other educational institutions implementing the general education program at the primary level (hereinafter referred to as primary schools), and related organizations and individuals.
Thus, the latest regulation for primary schools is the regulation issued along with Circular 28/2020/TT-BGDDT.

What are duties and rights of primary schools in Vietnam?
Based on Article 3 of the Regulation on Primary Schools, issued along with Circular 28/2020/TT-BGDDT, the duties and rights of primary schools are specified as follows:
- Publicly disclose the objectives, programs, educational plans, conditions ensuring quality education, and the results of the assessment and accreditation of educational quality; organize teaching, learning, and educational activities to meet the quality objectives and requirements of the general education program for primary level as issued by the Ministry of Education and Training.
- Implement compulsory education, education universalization, and literacy elimination in the locality. Encourage children to attend school at the correct age, and facilitate conditions for children in special circumstances to attend school. Support and manage educational activities of other educational institutions carrying out the primary level general education program as assigned by the competent authority.
- Develop strategies and plans for school development according to the regulations of the Ministry of Education and Training, linked with the local socio-economic conditions; develop educational activity plans to meet the objectives and requirements of the general education program for primary level.
- Implement the general education program for primary level issued by the Ministry of Education and Training; select textbooks as regulated by the Ministry of Education and Training; implement textbooks and local education content under the decisions of the People's Committees of provinces and centrally-governed cities (hereinafter referred to as provincial-level People's Committees); ensure academic autonomy in organizing educational activities at the primary school.
- Conduct self-assessment and ensure educational quality according to regulations.
- Manage personnel including staff, teachers, and students.
- Manage and use land, finances, and school property according to legal regulations.
- Closely cooperate with the parents or guardians of students, and organizations and individuals within the community to carry out educational activities. Organize teachers, staff, and students to participate in community activities in the locality.
- Create a cultural-educational environment within the school and participate in building a cultural-educational environment in the locality.
- Receive donations and sponsorships from organizations and individuals for the school under legal regulations.
- Carry out other duties and rights according to legal regulations.
What are types of primary schools in Vietnam?
According to Article 4 of the Regulation on Primary Schools, issued along with Circular 28/2020/TT-BGDDT, the regulation specifies the types of primary schools as follows:
Types of primary schools and classes
1. Primary schools are organized into two types: public and private.
a) Public primary schools are invested, ensured operational conditions, and represented by the State as the owner.
b) Private primary schools are invested and ensured operational conditions by domestic or foreign investors.
2. Primary classes in diverse educational institutions and special schools include:
a) Primary classes in multi-level comprehensive schools.
b) Primary classes in semi-boarding ethnic minority schools.
c) Primary classes in educational institutions for children with disabilities.
d) Primary classes in reformatory schools.
3. Other educational institutions implementing the primary level general education program include: community learning centers; classes for children in difficult circumstances who do not have the conditions to attend school, and classes for children with disabilities.
Thus, the regulation specifies two main types of primary schools: public and private.
