Pursuant to Article 5 of Decree 46/2017/ND-CP (amended by Clause 2, Article 1 of Decree 135/2018/ND-CP), the conditions for kindergartens, preschools, and junior kindergarten centers to operate educational activities are as follows:

- There must be a decision of establishment or a decision permitting the establishment by the Chairman of the district-level People's Committee.
- There must be land, infrastructure, facilities, and equipment meeting the requirements to maintain and develop educational activities, specifically:
a) Kindergartens, preschools, and junior kindergarten centers must be located in residential areas that comply with safety and environmental hygiene regulations;
b) The construction land area includes: The building area; playground area; green area, and pathways. The average minimum land area is 12 m² per child for the plains and midlands (excluding city districts and district-level towns); 8 m² per child for city districts, district-level towns, mountainous areas, and islands;
c) The premises of kindergartens, preschools, and junior kindergarten centers must be fenced off from outside;
d) The structure of the buildings includes:
- The area for children's groups and kindergarten classes: Common activity rooms, sleeping rooms, sanitary facilities, and play verandas ensuring compliance with standards;
- The learning support area: Physical education room, art education room, or multifunctional room;
- The dining area: Kitchen and storage area;
- Administrative area: School office, principal's room, vice-principal's room, administrative office, medical room, security room, staff room, sanitary facilities for teachers, staff, and employees, and parking area for teachers, staff, and employees;
- Playground areas: Group and class playgrounds; common playground.
e) There must be equipment, toys, supplies, and materials for child care and education as stipulated by the Ministry of Education and Training.
- There must be a sufficient number of managers, teachers, and staff with appropriate structure and standards to implement the preschool education program and organize educational activities.
- There must be sufficient financial resources as prescribed to ensure the maintenance and development of educational activities.

- The school council of public schools is an organization for school governance, exercising the ownership rights of the school and related stakeholders as stipulated:
a) The school council for junior kindergarten centers, kindergartens, preschools, general education facilities decides on the direction of school activities, mobilizes, and monitors the use of resources for the school, links the school with the community and society, ensuring the achievement of educational goals.
The composition of the school council for junior kindergarten centers, kindergartens, preschools, and general education facilities includes the party committee secretary, principal, trade union chairperson, secretary of the Ho Chi Minh Communist Youth Union, representative of the professional group, representative of the administrative office, local government representative, parent representative, and student representative for secondary schools, high schools;
b) The school council for vocational education institutions is implemented according to the Vocational Education Law;
c) The school council for higher education institutions is implemented according to the Higher Education Law.
