What is Fulbright University?

Fulbright University is the English name of Fulbright University Vietnam. This university is 100% foreign-invested, established according to Decision 819/QD-TTg of 2016.

Fulbright University was officially established in May 2016 according to Decision 819/QD-TTg of 2016.

Additionally, before establishing Fulbright University (Fulbright University), it must comply with investment capital conditions in Vietnam under Decree 86/2018/ND-CP.

What are the requirements for teaching staff at foreign-invested universities in Vietnam?

According to Clause 4, Article 38 of Decree 86/2018/ND-CP, foreign-invested universities in Vietnam must meet the following conditions for teaching staff:

- Instructors must have at least a master’s degree, with at least 50% of the instructors holding a doctoral degree, except for special training programs as decided by the Minister of Education and Training;

- The maximum student-to-faculty ratio is 10 students per instructor for specialized training programs, 15 students per instructor for science and technology programs, and 25 students per instructor for social sciences, humanities, and business administration programs;

- The educational institution must have sufficient full-time instructors to handle at least 60% of the total program volume for each training program;

- Foreign instructors teaching at foreign-invested higher education institutions must have university teaching experience in the same field of instruction, except as specified in point e of this clause;

- Native-speaking foreign instructors teaching foreign language skills at higher education institutions must hold at least a bachelor's degree and a relevant foreign language teaching certificate.

What is required in the dossier requesting the establishment of a foreign-invested university in Vietnam?

According to Article 41 of Decree 86/2018/ND-CP, the dossier requesting the establishment of a foreign-invested university must include:

- For preschools and general education institutions established by foreign diplomatic missions, intergovernmental international organizations, the dossier includes:

+ A request for permission to establish the educational institution according to Form No. 13 in the Appendix issued with Decree 86/2018/ND-CP;

+ An establishment scheme for the educational institution according to Form No. 14 in the Appendix issued with Decree 86/2018/ND-CP, clearly specifying: the name of the educational institution, educational goals and tasks, scope of educational activities, diplomas and certificates to be issued, proposed organizational and operational structure, and specific development and training scale plans for each phase, clearly outlining the ability to meet the quality assurance requirements stipulated in Articles 36, 37, and 38 of Decree 86/2018/ND-CP;

+ A certified copy or a copy accompanied by the original for comparison of the document of approval for the establishment of the educational institution at the local level and approval in principle for land lease by the Provincial People's Committee where the educational institution is to be located, or a preliminary agreement on land lease or existing facilities suitable with Clause 5 Article 36 of Decree 86/2018/ND-CP;

+ Documents proving financial capacity as stipulated in Article 35 of Decree 86/2018/ND-CP.

- For foreign-invested preschools, general education institutions, and higher education institutions, the dossier includes:

+ A request for permission to establish the educational institution as stipulated in Point a, Clause 1, Article 41 of Decree 86/2018/ND-CP;

+ A certified copy or a copy accompanied by the original for comparison of the investment registration certificate;

+ An establishment scheme for the educational institution as stipulated in Point b, Clause 1, Article 41 of Decree 86/2018/ND-CP;

+ A certified copy or a copy accompanied by the original for comparison of the document of approval for land lease from the Provincial People's Committee for constructing facilities (specifying the address, area, and boundaries of the land plot) or a preliminary agreement for leasing existing facilities in compliance with Clause 5, Article 36 of Decree 86/2018/ND-CP and related legal documents;

+ The facility development plan of the educational institution or the project for constructing facilities, including a detailed description and design of the educational institution;

+ Documents proving financial capacity as stipulated in Article 35 of Decree 86/2018/ND-CP.

Who has the authority to approve the establishment of a foreign-invested university in Vietnam?

According to Article 40 of Decree 86/2018/ND-CP, the authority to approve the establishment is stipulated as follows:

Authority to approve the establishment

1. The Prime Minister of the Government of Vietnam decides on the establishment of foreign-invested higher education institutions.

2. The Minister of Education and Training decides on the establishment of preschools and general education institutions proposed by foreign diplomatic missions and intergovernmental international organizations.

3. The Chairman of the Provincial People's Committee decides on the establishment of preschools and general education institutions, excluding the preschools and general education institutions stipulated in Clause 2 of this Article.

Thus, the Prime Minister of the Government of Vietnam has the authority to approve the establishment of foreign-invested universities.
