Based on Clause 5, Article 2 of the Law on Persons with Disabilities 2010:

Explanation of terms

In this Law, the following terms are understood as follows:

1. Persons with disabilities are those who have one or more parts of their body being impaired or whose functions are reduced, manifested in the form of disabilities causing difficulties in labor, daily life, and study.

2. Discrimination against persons with disabilities is the attitude of disdain or lack of respect towards persons with disabilities due to their disabilities.

3. Discrimination against persons with disabilities is the act of avoidance, refusal, abuse, slander, prejudice, or restriction of the rights of persons with disabilities due to their disabilities.

4. Inclusive education is the method of educating persons with disabilities alongside non-disabled persons in educational institutions.

What are cases of exclusive education in Vietnam?

Based on Article 28 of the Law on Persons with Disabilities 2010:

Methods of educating persons with disabilities

1. Methods of educating persons with disabilities include inclusive education, semi-inclusive education, and exclusive education.

2. Inclusive education is the primary method for educating persons with disabilities.

Semi-inclusive education and exclusive education are implemented in cases where conditions are insufficient for persons with disabilities to study under the inclusive education method.

3. Persons with disabilities, their parents, or their guardians select the method of education suitable for the development of the individual with disabilities. Families are responsible for creating favorable conditions and opportunities for persons with disabilities to study and develop their abilities.

The State encourages persons with disabilities to participate in education under the inclusive education method.

Thus, exclusive education is implemented when conditions are insufficient for persons with disabilities to study under the inclusive education method.

What are perspective and objectives of Establishing the Planning for the exclusive education System with the Vision to 2050 in Vietnam?

According to Article 1 of Decision 427/QD-TTg 2021 approving the tasks of establishing the Planning for the exclusive education System for Persons with Disabilities and the system of supportive centers for inclusive education development in the period of 2021-2030, with a vision to 2050, the perspective and objectives of establishing the planning for the exclusive education system are as follows:

* Perspective of establishing the planning

- The planning must ensure compatibility with the Party's policies, the State's laws on developing education for persons with disabilities, the socio-economic development strategy for the period 2021 - 2030, and related planning.

- Suitable with the characteristics of each territorial region, population structure, and the number of people with different types and levels of disabilities; creating favorable conditions for persons with disabilities to have equal opportunities to access and enjoy quality educational services, lifelong learning.

- Compatible with the State's investment capacity and the ability to mobilize social resources and national land use planning to develop the network of exclusive education institutions for persons with disabilities and supportive centers for inclusive education development; diversifying investment forms, management models towards promoting private investment, encouraging and mobilizing community and social resources to create conditions for persons with disabilities to access educational services, contributing to social progress and justice.

- The planning must be open and flexible, dependent on actual conditions and needs of the country, regions, localities to determine the quantity, scale of the exclusive education system for persons with disabilities and the supportive centers for inclusive education development across the country, each area appropriately, to best meet the lifelong learning needs of persons with disabilities.

* Objectives of establishing the planning

- Develop a system of exclusive education institutions for persons with disabilities and supportive centers for inclusive education development with sufficient capacity, scale, meeting the needs of accessing and enjoying quality educational services for all persons with disabilities; ensuring fairness in educational access.

- Serve as an effective, efficient state tool to organize space, manage the system of exclusive education institutions for persons with disabilities and supportive centers for inclusive education development.

- Serve as a basis to outline a roadmap and implement an effective medium-term public investment plan nationwide within the scope of state management to develop the system of exclusive education institutions for persons with disabilities and supportive centers for inclusive education development.

- Serve as a basis to encourage and mobilize community resources, socialization to develop the system of exclusive education institutions for persons with disabilities and supportive centers for inclusive education development, aiming to improve the quality of educational services, meet the learning needs of all persons with disabilities, towards the goal of social justice in educating persons with disabilities.
