Explanation of Terms

In this Decree, the following terms shall be understood as follows:

1. A foreign-invested educational institution is an educational institution funded by a foreign-invested economic organization, operating under Vietnamese law, entitled to use its own seal and account.

2. A short-term training institution is a foreign-invested educational institution, including foreign language, information technology, culture, skills, professional and specialized training centers, including training institutions established by foreign diplomatic missions or intergovernmental international organizations allowed to operate in Vietnam.

3. An integrated education program is the Vietnamese education program integrated with a foreign education program, ensuring the goals of the Vietnamese education program and avoiding content and knowledge overlap.

4. Educational linkage is the cooperation between Vietnamese preschool and general education institutions and foreign education institutions to implement the integrated education program.

5. Training linkage is the cooperation between a Vietnamese higher education institution and a foreign higher education institution to implement training programs for granting degrees or certificates without establishing a legal entity.

6. A branch campus of a foreign-invested higher education institution is a unit within the organizational structure and under the management and administration of a foreign-invested higher education institution operating in Vietnam.

At the same time, a branch campus of a university with foreign investment must be under the management and administration of the foreign-invested higher education institution operating in Vietnam.

Who has the authority to issue operation permit for branch campuses of foreign-invested universities in Vietnam?

Based on Clause 1, Article 47 of Decree 86/2018/ND-CP:

Authority to Permit Educational Operations

1. The Minister of Education and Training permits educational operations for foreign-invested higher education institutions and their branch campuses.

2. The Director of the Department of Education and Training permits educational operations for:

a) Short-term training institutions;

b) Preschools, primary schools, lower secondary schools, upper secondary schools, and multi-level schools;

c) Preschools and general education institutions established by foreign diplomatic missions or intergovernmental international organizations.

Therefore, according to legal provisions, the Minister of Education and Training authorizes the educational operations of branch campuses of universities with foreign investment.

What documents are required for registering dducational operations of a branch campus of a university with foreign investment in Vietnam?

Based on Article 46 of Decree 86/2018/ND-CP, the following documents are required for the registration of educational operations of a branch campus of a university with foreign investment:

[2] Authenticated copy or a copy accompanied by the original for comparison of the decision permitting establishment for the foreign-invested educational institution; authenticated copy or a copy accompanied by the original for comparison of the investment registration certificate and business registration certificate for the short-term training institution with foreign investment.

[3] Organizational and operational regulations of the educational institution.

[4] Progress report on the implementation of the investment project, status of capital contribution, loans, and total investment capital realized.

[5] Explanation report on how the educational institution or branch campus of the higher education institution has met the requirements stipulated in Articles 35, 36, 37, and 38 of Decree 86/2018/ND-CP, including:

- List of rector (director), vice-rector (deputy director), heads of faculties, departments, and chief accountant. For the branch campus education operation permit application, the list of personnel in charge of the branch campus and its organizational structure must be included;

- List and personal profiles of permanent and visiting staff, teachers, and lecturers;

- Description of educational levels, training levels, and training sectors;

- Teaching programs, teaching plans, study materials, textbooks, and main reference documents;

- Admission targets, regulations, and admission periods;

- Training regulations;

- Training scale (students, trainees);

- Regulations on tuition fees and related fees;

- Regulations on testing, evaluation, and recognition of course, module, education level completion;

- Sample degrees and certificates to be used.
