Pursuant to Article 7 of the Regulation on visiting teacher policies in educational institutions issued together with Circular 44/2011/TT-BGDDT, the regulation on visiting teacher contracts is as follows:
Visiting Teacher Contract
- For visiting teachers who are officials and public employees:
a) The visiting teacher contract is a service contract. The conclusion, performance, amendment, and termination of the visiting teacher contract follow the provisions of Section 7, Chapter XVII of the Civil Code. Labor contracts are not applied to visiting teacher activities of officials and public employees.
b) The visiting teacher contract must include a clause where the visiting teacher commits to ensuring the completion of tasks at their place of work.
- For visiting teachers who are not officials and public employees:
a) For the activities specified in points a, b, c, d, clause 1, Article 2 of this Regulation, the visiting teacher contract is a labor contract as stipulated in the Labor Code. The conclusion, performance, and termination of visiting teacher contracts, as well as complaint, denunciation, and the handling of complaints and denunciations, follow the provisions of labor law.
b) For the visiting teacher activities specified in point đ, clause 1, Article 2 of this Regulation, the visiting teacher contract is a service contract. The conclusion, performance, amendment, and termination of the visiting teacher contract follow the provisions of Section 7, Chapter XVII of the Civil Code.
Thus, the visiting teacher contract is a service contract. The conclusion, performance, amendment, and termination of the visiting teacher contract follow the provisions of the Civil Code. Labor contracts are not applied to the visiting teacher activities of officials and public employees.

Pursuant to Article 8 of the Regulation on visiting teacher policies in educational institutions issued together with Circular 44/2011/TT-BGDDT, visiting teachers have the following responsibilities:
- Perform the duties of educators as stipulated by education law.
- Comply with the legal provisions related to visiting teacher contracts.
- Fulfill the commitments of the visiting teacher contract.
- Visiting teachers who are officials and public employees must ensure completion of tasks at the agency or organization where they work; integrate the adjunct lecturing plan into their work program; report to the head of the agency or organization before concluding and after terminating the visiting teacher contract.
What are rights of visiting teachers in Vietnam?
Pursuant to Article 9 of the Regulation on visiting teacher policies in educational institutions issued together with Circular 44/2011/TT-BGDDT, the rights of visiting teachers are stipulated as follows:
Rights of visiting teachers
To receive wages, salaries, and benefits according to the agreement in the visiting teacher contract and as specified by law.
To participate in professional activities, professional development, pedagogical training, to be facilitated for scientific research at the visiting teacher institution, to be considered for awards, to be recognized for meeting standards and appointed to the titles of Professor, Associate Professor in accordance with the law.
To be provided by the visiting teacher institution with necessary materials, equipment, and working means; to be evaluated, ranked, and rewarded if having achievements in educational and training activities according to the law.
Thus, visiting teachers have the following rights:
