Types of schools in the national education system
1. Schools in the national education system are organized into the following types:
a) Public schools, which are invested in, ensured operational conditions, and represented by the State;
b) People-founded schools, which are invested in, having infrastructures built and ensuring operational conditions by community members, including organizations and individuals at village, hamlet, ward, commune-level town levels.
The type of community-based school applies only to preschool education institutions;
c) Private schools, which are invested in and ensured operational conditions by domestic or foreign investors.
Non-profit private schools are those in which investors commit and execute non-profit operations as recorded in the establishment decision or conversion decision; non-profit, without capital withdrawal, no profits taken; annual accumulated profits are undivided common ownership to continue reinvestment in school development.

What are the principles for converting types of schools in the national education system in Vietnam?
According to Clause 2, Article 47 of the Education Law 2019, the conversion of types of schools in the national education system is performed according to the following principles:
- Only convert from private schools to non-profit private schools;
- Comply with the regulations of the charter, organizational and operational regulations of the school type at each education level, training level;
- Ensure the rights of teachers, lecturers, educational administrators, workers, and learners;
- Avoid loss of land, capital, and assets.
What are procedures for converting a private general education institution to a non-profit private general education institution in Vietnam?
According to Article 7 of Decree 84/2020/ND-CP, the procedures for converting a private general education institution to a non-profit private general education institution are as follows:
Step 1: Submit the application
The private general education institution sends one set of documents directly or by post or submits online with a soft copy to:
- The District-level People's Committee for private primary schools, private lower secondary schools, and private multi-level schools with the highest level being lower secondary schools, invested and ensured operational conditions by domestic investors;
- The Provincial-level People's Committee for private upper lower secondary schools, private multi-level schools with the highest level being upper lower secondary schools, invested and ensured operational conditions by domestic investors and private general education institutions invested and ensured by foreign investors;
- The Ministry of Education and Training for private general education institutions requested by foreign diplomatic missions, intergovernmental international organizations;
The conversion application includes:
- A submission request to convert the private general education institution to a non-profit private general education institution, clearly stating the necessity of conversion; non-profit operational principles and purposes; the contributed capital, undivided common ownership properties of the school (if any);
- Commitment documents from investors representing at least 75% of the total contributed capital for the private general education institution converting to a non-profit private general education institution, ensuring non-profit operation, no capital withdrawal, no profit-taking; annual accumulated profits are undivided common ownership to continue reinvestment in the private general education institution;
- Draft organizational and operational regulations; draft internal financial regulations of the non-profit private general education institution;
- Copies, certified from the main register, or copies with the original documents for comparison of the audit result report;
Agreements on solving contributed capital for investors not agreeing to the conversion to a non-profit private general education institution (if any);
Documents, materials on land, properties, finances, organization, and personnel of the private general education institution converting to a non-profit private general education institution;
- Impact evaluation report of the conversion on human resources, finances, assets, and handling solutions;
- Establishment decision of the private general education institution, the current school board recognition decision, the current principal recognition decision of the private general education institution, and other relevant documents (if any).
Step 2: Dossier appraisal and conversion decision
Within 20 working days from the date of receiving the complete dossier, the competent authority organizes the dossier appraisal and submits to the District-level People's Committee or the Provincial-level People's Committee as per jurisdiction to decide the conversion.
Within 20 working days from the date of receiving the complete dossier, the Ministry of Education and Training organizes the dossier appraisal and makes a conversion decision for private general education institutions requested by foreign diplomatic missions, intergovernmental international organizations.
The conversion decision is publicly announced on the electronic portal or website of the conversion decision-making authority.
In the case that the dossier does not meet the requirements, within 5 working days from the date of receiving the file, the District-level People's Committee, the Provincial-level People's Committee, or the Ministry of Education and Training sends a written notice to the private general education institution, stating the reasons.
