What are the standards for lecturers in Vietnam sent abroad by higher education institutions for scientific research?
Based on Article 17 of Decree 86/2021/ND-CP, the standards for lecturers sent abroad for scientific research are as follows:
- Possess good political and ethical qualities;
- Not under disciplinary action or criminal prosecution;
- Have qualifications and capabilities that match the content and program of the scientific research participation;
- Meet other requirements of the scientific research program abroad;
- Have the consent to be sent abroad from the higher education institution.
What are the rights and obligations of higher education lecturers in Vietnam sent abroad for scientific research?
According to Article 19 of Decree 86/2021/ND-CP, the rights and responsibilities of higher education lecturers sent abroad for scientific research are as follows:
- Rights:
+ Protected by the Vietnamese representative agency abroad concerning their lawful rights and interests in accordance with Vietnamese law, the law of the host country, and international laws and practices during the time researching abroad;
+ Permitted to transfer salary, wages, income, and other personal assets back to Vietnam under Vietnamese law and the law of the host country;
+ If employed by an agency or organization benefiting from the state budget, they are entitled to salary, wages, other income, medical examination and treatment policies, social insurance, and other benefits based on agreement with the direct management agency and to resume work upon completion of their duties abroad.
- Responsibilities:
+ Comply with the decision to be sent abroad for scientific research;
+ Strictly abide by Vietnamese law and the law of the host country; register as a Vietnamese citizen residing abroad according to current regulations;
+ Pay social insurance, health insurance, personal income tax (if any), and other mandatory fees according to current State regulations; if an international treaty to which Vietnam is a party provides for personal income tax differently from current Vietnamese income tax law, comply with the international treaty;
+ Protect state secret documents and information as regulated by the Law on State Secrets Protection and internal political protection information;
+ Not misuse their work or professional activities to engage in propaganda activities against the Vietnamese state, affecting diplomatic relations between Vietnam and the partner country;
+ Not violate regulations on scientific and technological activities of Vietnam and the host country; comply with current legal regulations on the duties and responsibilities of educators, affecting the image and prestige of Vietnam in the partner country;
+ Work at the specified location; strictly follow workplace rules; return to Vietnam after the foreign scientific research program ends according to the partner country's regulations;
+ Not misuse the scientific research abroad for unauthorized labor or illegal stay abroad, except in cases of extended stay due to illness, war, natural disaster, or epidemic;
+ Abide by agreements and commitments signed with direct management agencies and authorized agencies to send individuals abroad for scientific research (if any);
+ Follow current regulations for officials and public employees and Communist Party regulations (for officials, public employees, and party members);
+ Submit reports to the direct management agency every three months. Within 20 working days from the end of the overseas research period, individuals must return to Vietnam and report to the direct management agency and the authorized agency to send Vietnamese citizens abroad for scientific research (if any) and update into the database system specified in Article 4 of Decree 86/2021/ND-CP.

According to Article 20 of Decree 86/2021/ND-CP, the rights and responsibilities of higher education institutions sending lecturers abroad for scientific research are as follows:
- Rights:
+ Exercise rights related to foreign cooperation as stipulated in Article 44 of the Higher Education Law 2012 and Article 71 of the Science and Technology Law 2013;
+ Organize resources, select, train, and send individuals to conduct scientific research abroad;
+ Require individuals sent for scientific research abroad to adhere to the institution's regulations or any bilateral agreements before going abroad (if any);
+ Request individuals sent for scientific research abroad to report their work results during their time abroad.
- Responsibilities:
+ Select individuals with the necessary political quality, ethics, competence, and professional standards to send for teaching, scientific research, and academic exchange abroad;
+ Monitor the activities of individuals sent abroad for scientific research and receive them back after the completion of the teaching, scientific research, and academic exchange program abroad;
+ Report the number of individuals sent abroad for scientific research to the authorized agency (if any) and in accordance with Article 28 of Decree 86/2021/ND-CP.
