What is the procedure for establishing a foreign language and computer training center in Vietnam?

According to the provisions of Article 47 Decree 46/2017/ND-CP amended by Clause 20, Article 1 Decree 135/2018/ND-CP, the procedure for establishing a foreign language and computer training center is as follows:

- Authority to establish foreign language and computer training centers:

+ Directors of universities, academies, principals of universities, and pedagogical colleges decide to establish foreign language and computer training centers within the school campus;

+ Heads of social organizations, socio-professional organizations, and economic organizations permitted by law to establish affiliated training centers have the authority to decide on affiliated foreign language and computer training centers;

+ Directors of the Department of Education and Training decide to establish affiliated foreign language and computer training centers; permit the establishment of foreign language and computer training centers affiliated with universities, academies, universities, and pedagogical colleges outside the school campus and foreign language and computer training centers as stipulated in Point b, Clause 1, Article 47 Decree 46/2017/ND-CP.

- Implementation procedure:

Step 1: Organizations and individuals send directly or through the mail 01 set of application documents to the authority competent to establish foreign language and computer training centers;

The application documents include:

- Proposal for establishing a foreign language and computer training center;

- Establishment scheme for the foreign language and computer training center including details: Center name, center location, necessity and legal basis for the establishment of the center; objectives, tasks of the center; teaching programs, training scale; facilities of the center; organizational structure of the center, résumé of the expected center director;

- Draft internal regulations on the organization and operation of the foreign language and computer training center.

- Within 10 working days from the date of receiving complete and valid documents, the competent authority for the establishment of foreign language and computer training centers is responsible for appraisal and inspection as prescribed;

- Within 05 working days, the competent authority decides to establish or permit the establishment of the foreign language and computer training center if the requirements are met; if not yet established, there is a written notice to the organization or individual clearly stating the reasons.

What is the procedure for educational operations of a foreign language and computer training center in Vietnam?

According to the provisions of Article 49 Decree 46/2017/ND-CP amended by Clause 22, Article 1 Decree 135/2018/ND-CP, the procedure for foreign language and computer training centers to operate in education is as follows:

- Authority to permit educational activities (1)

+ Directors of the Department of Education and Training decide to permit educational activities for foreign language and computer training centers stipulated at Points b and c, Clause 1, Article 47 Decree 46/2017/ND-CP;

+ Directors of universities, academies; principals of universities, colleges decide to permit educational activities for foreign language and computer training centers operating within the campus of the school.

- Implementation procedure:

Step 1: The foreign language and computer training center sends directly or through the mail 01 set of application documents to the competent authority as stipulated in (1).

The application documents include:

- Proposal for educational activity license;

- Copies issued from the original register, certified copies from the original or copies accompanied by the original for comparison of the establishment decision of the center issued by the competent authority;

- Internal educational activity regulations of the center;

- Report on facilities, equipment, programs, teaching materials; management team, teachers; documents proving the legal use of land, buildings; funding sources ensuring the operation of the center.

Step 2: Within 05 working days from the date of receiving the documents, the competent authority acknowledges receipt of the documents. If unsatisfactory, a written notice of the contents that need amendment or supplementation is sent to the center;

Step 3: Within 10 working days from the date of receiving satisfactory documents, the competent authority cooperates with relevant agencies and units to conduct actual appraisal of the ability to meet the prescribed requirements and record the appraisal results in the appraisal report;

Within 05 working days from the date of the appraisal results, the competent authority decides to permit the center to operate in education. If not yet permitted to operate in education, a written notice is sent to the center clearly stating the reasons.
