What are the regulations on the number of children in a category of daycare group in Vietnam?

Based on Article 14 of the Regulations on the Organization and Operation of Independent daycare groups, Independent Kindergartens, and Independent Nurseries of Public and Private Types, issued with Circular 49/2021/TT-BGDDT, the organization of daycare groups and kindergartens is as follows:

* Children in an independent early childhood education institution are organized into daycare groups or kindergartens.

- For daycare groups: Children from 3 months to 36 months old are organized into different daycare groups. The maximum number of children in each group is specified as follows:

+ Childcare group for children aged 3-12 months: 12 children;

+ Childcare group for children aged 13-24 months: 20 children;

+ Childcare group for children aged 25-36 months: 25 children.

- For kindergartens: Children from 3 years old to 6 years old are organized into kindergartens. The maximum number of children in each kindergarten class is specified as follows:

+ Kindergarten class for children aged 3-4 years: 25 children;

+ Kindergarten class for children aged 4-5 years: 30 children;

+ Kindergarten class for children aged 5-6 years: 35 children.

- If the number of children in each childcare group or kindergarten does not reach 50% of the maximum number specified above, they can be organized into mixed daycare groups with no more than 20 children, mixed kindergarten classes with no more than 30 children, or mixed nursery classes with no more than 22 children.

- Each childcare group or kindergarten class shall have no more than 1 child with disabilities integrated.

- In places where the number of children is insufficient to organize into groups or classes as specified in Clause 1, Article 14 of the Regulations issued with Circular 49/2021/TT-BGDDT, the teacher-student ratio will be calculated based on the average number of children per age group in each group or class, specifically:

+ For daycare groups: 1 teacher to nurture, care for, and educate 3 children aged 3-12 months or 8 children aged 13-24 months or 10 children aged 25-36 months;

+ For kindergarten classes: 1 teacher to nurture, care for, and educate 11 children aged 3-4 years, or 14 children aged 4-5 years, or 16 children aged 5-6 years;

- Each childcare group or kindergarten class must have at least 2 teachers.

- The total number of children in an independent early childhood education institution shall not exceed 70 children.

Thus, the arrangement of the number of children in private daycare groups is based on the age of the children to arrange appropriately according to regulations.

Based on Article 8 of the Regulations on the Organization and Operation of Independent daycare groups, Independent Kindergartens, and Independent Nurseries of Public and Private Types, issued with Circular 49/2021/TT-BGDDT, the private daycare groups will be organized as follows:

- Children in independent daycare groups with a maximum size of 7 children aged from 3 months to 36 months.

- One caregiver, care provider, and educator can directly nurture, care for, and educate a maximum of 2 children from 3-12 months old or a maximum of 3 children from 12-36 months old.

- Each childcare group shall have no more than 1 child with disabilities.

Do private independent private daycare groups belong to the national education system in Vietnam?

Based on Clause 1, Article 65 of the Education Law 2019, other educational institutions are regulated as follows:

Other Educational Institutions

1. Other educational institutions within the national education system include:

a) Independent daycare groups, independent kindergartens, independent nurseries, literacy classes, foreign language classes, computer classes, classes for children in difficult circumstances who cannot attend school, classes for children with disabilities;

b) Centers for continuing education, centers for vocational education - continuing education, vocational education centers, community learning centers, centers for inclusive education development support, and other centers performing continuing education tasks;

c) Academies, institutes established by the Prime Minister according to the provisions of the Law on Science and Technology, permitted to offer doctoral education.

2. The head of the educational institution specified in Clause 1 of this Article shall be responsible for the quality of education, management, and operation of the institution in accordance with the law.
