What are the regulations on grading the quality of teachers in Vietnam?
Under Article 2 of the Law on Public Employees 2010 on public employees:
Public employees
Public employees are Vietnamese citizens recruited according to working positions, working in public non-business units under working contracts and salaried from salary funds of public non-business units in accordance with law.
Under Article 42 of the Law on Public Employees 2010 as amended and supplemented by Point b, Clause 12, Article 2 of the Law on Amendments to Law on Officials and Law on Public Employees 2019 regarding grading of the quality of public employees, the following provisions apply:
Grading of quality of public employees
1. Annually, based on the assessment content, the quality of public employees are graded as follows:
Excellent completion of duties;
Successful completion of duties;
Completion of duties;
Non completion of duties.
Thus, the quality of teachers as public employees is assessed and graded by four levels:
Excellent completion of duties;
Successful completion of duties;
Completion of duties;
Non completion of duties.
What are the procedures for assessing and grading the quality of teachers not holding managerial positions in Vietnam?
Clause 2, Article 19 of Decree 90/2020/ND-CP sets forth the procedures for assessing and grading the quality of teachers not holding managerial positions as follows:
Step 1: Self-assessment and quality grading by the teacher
Teachers prepare a self-assessment report on their work results according to assigned duties as per form number 03 attached to this Decree.
Step 2: Remarks and assessment of teachers
Organize a meeting at the unit where the teacher works for remarks and assessment.
Participants in the meeting include all public employees of the unit or all public employees of the subsidiary unit where the teacher works in case the unit has subsidiaries.
Teachers present their self-assessment report on work results at the meeting, where participants give their opinions, which must be recorded in the minutes and approved at the meeting.
Step 3: Review and decide on the assessment and quality grading of the teacher.
The competent authority assesses and grades the quality based on the opinions at the assessment meeting as stipulated in point b of this clause, deciding the assessment content and quality grading level for the teacher.
Step 4: The competent authority assesses and grades the quality of the teacher, informs the teacher in writing, and publicly announces the assessment and grading results in the agency, organization, or unit where the teacher works.

What is the deadline for assessing and grading the quality of teachers in Vietnam?
Article 20 of Decree 90/2020/ND-CP stipulates as follows:
Timing of annual quality assessment and grading for officials and public employees
1. The quality assessment and grading for officials and public employees are conducted annually.
For officials and public employees transferred to new work units, the new agency, organization, or unit is responsible for the assessment and grading. If the official or public employee has worked at the former unit for six months or more, the opinions of the former unit must be considered, except when the former unit no longer exists.
2. The quality assessment and grading for officials and public employees must be conducted before December 15 annually, prior to the assessment of party members and the annual assessment of achievements and rewards at the agency, organization, or unit.
For public service providers in education, training, and other sectors with work years ending before December, the head of the public service provider decides the timing for assessing and grading the quality of public employees.
3. At the time of the assessment and grading, in cases of justified absence or legal sickness leave, maternity leave, officials and public employees must prepare a self-assessment report and receive work results grading corresponding to the assigned duties, submitting it to their working agency, organization, or unit for quality assessment and grading as stipulated by this Decree.
Based on clauses 1 and 2 of this Article and the specific circumstances of the agency, organization, or unit, its leadership collectively with the same-level CPV committee decide on organizing assessment and grading meetings, ensuring seriousness, effectiveness, and avoiding formalism and waste.
Thus, the quality assessment and grading of teachers must be conducted before December 15 annually.
