What are the fines imposed on preschools in Vietnam for failure to publicize information about teaching staff?
Based on point c, clause 2, Article 7 of Decree 04/2021/ND-CP, the regulations are as follows:
Violation of regulations on the organization and management of educational establishments
- A fine of between VND 10,000,000 and VND 20,000,000 shall be imposed for one of the following acts:
a) Failing to fully publicize the contents as required by the regulation on public implementation for educational and training institutions within the national education system and other related legal documents;
b) Inadequately or inaccurately implementing policies on information reporting as prescribed by current law;
c) Preparing periodic reports, ad-hoc reports with inaccurate content;
d) Using names or setting up offices at locations not specified in the establishment decision or the permit;
đ) Failing to perform or incorrectly performing accountability as prescribed by current law.
2. A fine of between VND 20,000,000 and VND 30,000,000 shall be imposed for one of the following acts:
a) Issuing incomplete or inadequately implementing documents within the responsibility of the educational establishment as prescribed by current law;
b) Inaccurately disclosing information as required by current law;
c) Failing to publicize information as required by current law;
d) Failing to implement policies on information reporting as prescribed by current law;
đ) Failing to send notifications or decisions of higher education institutions to the Ministry of Education and Training as prescribed by current law.
- A fine of between VND 30,000,000 and VND 40,000,000 shall be imposed for issuing unauthorized or unlawful documents.
- A fine of between VND 40,000,000 and VND 60,000,000 shall be imposed for failing to establish a school council of the higher education institution as prescribed by current law.
5. Remedial measures:
a) Forcing the public disclosure as required for violations stated at point a, clause 1, and point c, clause 2 of this Article;
b) Forcing correction of false information for violations stated at point b, clause 2 of this Article;
c) Forcing the annulment of unauthorized or unlawful documents for violations stated at clause 3 of this Article.
Based on point b, clause 3, Article 3 of Decree 04/2021/ND-CP, the regulation on fine levels are as follows:

b) The levels of fines stated in Chapter II of this Decree are applied to administrative violations of organizations, except for the regulations at clause 5, Article 9, clause 2, Article 11, clause 1 and points a, b, c, d, e clause 3, Article 14, point b, clause 3, Article 21, clause 1, Article 23, clause 1, Article 29 of this Decree, which are fine levels applied to administrative violations of individuals. For the same administrative violation, the fine level for individuals shall be half of the fine level for organizations.

Thus, preschools that do not publicize information about the teaching staff will be fined from VND 20,000,000 to VND 30,000,000 and required to publicize information about the teaching staff as regulated.

What financial information must a preschool in Vietnam publicly disclose?
Based on Article 5 of Circular 09/2024/TT-BGDDT, preschools must publicly disclose the following financial information:
(1). The financial situation of the preschool in the fiscal year immediately preceding the report as per the legal regulations, including the structure of revenue and expenditure activities as follows:
- Revenue categorized by: Source of funds (state budget, investor support; tuition fees, charges, and other fees from learners; sponsorship and contract funds; other sources) and type of activity (education and training; science and technology; other activities);
- Expenditures categorized by: Salary and income expenses (salaries, allowances, additional salaries, and other expenses similar to salaries for teachers, lecturers, administrators, staff,...); expenditure on facilities and services (procurement, maintenance, repair, and operation of facilities, equipment, rental services directly serving education, training, research, development,...); support expenditures for learners (scholarships, allowances, living support, movement activities, commendation,...); other expenditures.
(2). Fees and tuition fees for learners, including all fees and charges beyond tuition fees, within the academic year, and projected for each year of the education level or course before enrollment.
(3). Annual policies and results of implemented policies on allowances and tuition fee waivers, and scholarships for learners.
(4). Balances of funds as per regulations, including special funds (if any).
(5). Other public financial contents as per regulations on finance, budget, accounting, auditing, grassroots democracy.
What information about infrastructure must a preschool in Vietnam publicly disclose?
Based on clause 2, Article 6 of Circular 09/2024/TT-BGDDT, preschools must publicly disclose information about their infrastructure, including the following:
- Land area for constructing the school, school points, the minimum average area per child; comparison with the minimum requirements as per regulations;
- The number and categories of administrative management buildings; child nurturing, care, and educational buildings; dining buildings (applicable to preschools organizing meal preparation); supporting facilities; technical infrastructure; comparison with the minimum requirements as per regulations;
- Quantity of existing equipment, tools, and toys; comparison with the minimum requirements as per regulations;
- Quantity of outdoor toys, certain equipment, and conditions for nurturing, caring, and educating children.
