Pursuant to Article 50 of Decree 115/2020/ND-CP, the reappointment of public employees in educational management is conducted when the following criteria and conditions are met:
- Completion of tasks during the term of holding a management position.
- Meeting the standards of management titles as prescribed by competent agencies or units at the time of reappointment.
- The unit has demand for the job position of public employees in management.
- Being healthy enough to fulfill the assigned duties and responsibilities.
- Not belonging to any cases prohibited from holding a position according to the law.

What are the procedures for the reappointment of public employees in educational management in Vietnam?
Based on Article 51 of Decree 115/2020/ND-CP (amended by Clauses 28, 29 of Article 1 in Decree 85/2023/ND-CP), the procedures for reappointment of public employees in educational management are conducted as follows:
Step 1: No later than 90 days before the expiration of the appointment term, the competent agency or unit must issue a notice to carry out the process of considering reappointment for the public employee.
Step 2: The public employee prepares a self-assessment report evaluating the performance of duties during the term of office.
Step 3: Organize a key staff meeting to collect opinions on the reappointment
- Components: Conduct as specified in step 4 of the public employee management appointment process.
- Procedure: The public employee under consideration for reappointment reports self-assessment and evaluation of the performance of duties during the term of office; the meeting participates in giving comments and conducting a secret ballot of confidence for the public employee under consideration for reappointment.
- The meeting minutes and the confidence vote count report are sent to the head of the competent agency or unit for appointment. The results of the vote count are not announced at this meeting.
Step 4: The collective leadership of the unit discusses and votes on personnel
- Components: Conduct as specified in step 5 of the public employee management appointment process.
- Procedure:
+ Analyze vote results from the key staff meeting. The public employee proposed for reappointment must achieve more than 50% of the total number of people summoned to participate in the key staff meeting. If the rate is 50% or less, report to the authority for consideration and decision on continuing the process.
+ Verify and conclude on newly arising issues (if any).
+ Collect written opinions from the executive committee of the party committee, cell, or party committee about the personnel proposed for reappointment.
+ The collective leadership discusses, reviews, evaluates, and votes on personnel by secret ballot. The personnel proposed for reappointment must achieve more than 50% consent of the total leadership members, if achieving 50%, it will be decided by the head according to their authority or submitted to a higher authority for consideration, or if the rate is below 50%, report all differing opinions for competent authority consideration and decision.
Step 5: The head of the public service provider issues a reappointment decision according to authority or submits it to a higher authority for consideration and decision.
Under what circumstances are public employees in educational management in Vietnam not eligible for reappointment?
Pursuant to Article 49 of Decree 115/2020/ND-CP, the timing, term, and principles for reappointment and extension of management positions are as follows:

- A reappointment decision or an extension decision of the management position must be issued at least 01 working day before the expiration of the appointment term.
- In the case of managerial public employees whose appointment term has ended without a reappointment or extension decision from the competent agency or unit, they are not allowed to perform the tasks, duties, and authorities of the current management position. The performance thereof is to be considered and decided by the competent agency or unit for appointment.
- Cases where the reappointment process or extension of the management position term have not been conducted:
a) Managerial public employees under disciplinary action, being investigated, prosecuted, or tried;
b) Managerial public employees during the period of being sent by a competent agency or unit for study or work abroad for 03 months or more;
c) Managerial public employees during the period of inpatient treatment for 03 months or more at medical facilities or during maternity policy leave.
Therefore, the following cases have not conducted the reappointment process for public employees in educational management:
- Managerial public employees under disciplinary action, being investigated, prosecuted, or tried;
- Managerial public employees during the period of being sent by a competent agency or unit for studying or working abroad for 03 months or more;
- Managerial public employees during the period of inpatient treatment for 03 months or more at medical facilities or during maternity policy leave.
