What are regulations on student regulations in primary, lower secondary, and upper secondary schools in Vietnam? Is expulsion the highest form of disciplinary action for not complying with these regulations?

What are regulations on the student regulations in Vietnam? 

Currently, there are no specific regulations regarding student rules. These rules are individually set by each school, each educational level, and each class. However, student regulations are a set of rules about what students should do and what they are prohibited from doing when participating in the educational environment at the school they attend.

Student regulations are established for students to strictly comply with; if any student violates these regulations, the school will impose disciplinary actions accordingly. Conversely, commendation forms will be given for good performance and adherence to these regulations.

Additionally, compliance with student regulations is also the personal duty of each student as stated in Article 34 of the Charter for lower secondary schools, upper secondary schools, and schools with multiple educational levels, promulgated along with Circular No. 32/2020/TT-BGDDT as follows:

- Respect parents, school staff, teachers, employees, and elders; unite and help each other in learning and practice; adhere to the school charter, school regulations; comply with the State's laws.

Simultaneously, in Article 34 of the Charter for Primary Schools promulgated with Circular No. 28/2020/TT-BGDDT as follows:

- Study and practice according to the educational plan and school regulations; consciously study and practice to comprehensively develop qualities and abilities according to the goals of the primary general education program.

- Comply with regulations, protect school property and public property; obey traffic safety rules; maintain hygiene and environmental protection.

Below are some examples of student regulations for primary, lower secondary, and upper secondary schools:

Student Regulations

(Primary Level)

Article 1: Study and follow Uncle Ho's 5 teachings, love and respect the national flag, the national emblem, Uncle Ho's portrait, sing the national anthem correctly, and be solemn during flag ceremonies.

Article 2: Respect, be polite, and obey teachers. Greet teachers when meeting them, obey grandparents, parents, and be considerate to siblings.

Article 3: Be grateful and help war invalids, martyr families, assist the elderly, and young children. Do not mock the disabled. Thank those who help you and apologize when you inconvenience others.

Article 4: Walk on the right side of the road and wear a helmet when riding a motorbike. Return lost items to their owners.

Article 5: Attend school on time, and greet grandparents, parents, and elders when leaving and returning home. Seek permission for absences. Complete homework fully and prepare necessary study materials. Dress neatly according to school regulations.

(Lower Secondary Level)

Article 1: Strive to study and practice according to Uncle Ho's 5 teachings, always uphold the qualities of a student under the socialist school, fulfill all responsibilities and obligations as a citizen. Seriously follow the Party's line, State's laws, the charter for Secondary Schools, educational regulations, and school rules.

Article 2: Actively participate in extracurricular activities, group activities, and school-organized events.

Article 3: Be conscious of protecting school property, and strictly prohibit any acts of vandalism to the facilities and environment. Do not loiter in the administrative areas without duty or tasks.

Article 4: Do not participate in or use prohibited substances, or bring dangerous items to school...

Article 5: Respect and be polite to teachers, and harmonize with fellow students.

Student Regulations

(Upper Secondary Level)

Article 1: Strive to study and practice according to Uncle Ho's 5 teachings, respect the national flag, and learn the national anthem.

- Participate fully in flag-raising ceremonies, collective activities, and events organized by the school.

- Continuously cultivate ethics, be honest, humble, healthy, cultured, responsible, and uphold the school's reputation.

Article 2: Attend school regularly and punctually, do not skip classes or periods.

Article 3: Respect and be polite to teachers, and harmonize with fellow students. Do not use foul language, swear, drink alcohol, smoke, gamble, use stimulants, carry indecent materials, bring weapons or explosives to school… initiate conflicts, fight, allow outsiders into the school, or form groups to disturb security both inside and outside the school.

Article 4: Dress neatly and in accordance with the prescribed school uniform.

Article 5: Protect school and public property, as well as the property of classmates and oneself. Promote solidarity in the learning environment.

What disciplinary measures will be taken if secondary school students in Vietnam do not comply with student regulations?

Based on Clause 2 of Article 38 of the Charter for lower secondary schools, upper secondary schools, and schools with multiple educational levels, promulgated along with Circular No. 32/2020/TT-BGDDT, the regulations on Commendation and Discipline are as follows:

Commendation and Discipline

1. Students achieving accomplishments in their studies and practice are commended by teachers, schools, and educational management levels through the following forms:

a) Commendation before the class or the entire school.

b) Awarding student titles as prescribed.

c) Issuing certificates of merit, commendation letters, or awards if achieving outstanding performance or significant progress in certain areas of study, contest movements; achieving results in exams or competitions as prescribed and allowed by the Ministry of Education and Training.

d) Other forms of commendation.

2. Students committing mistakes in the learning and practicing process are educated or disciplined through the following forms:

a) Direct reminders, support, and assistance to help students correct mistakes.

b) Reprimands, notifications to parents for coordination in helping students correct mistakes.

c) Temporary suspension from school with duration and implementation of other education measures as prescribed by the Ministry of Education and Training.

Thus, according to the above regulations, non-compliance with student regulations (in general) involves the following disciplinary measures:

- Direct reminders, support, and assistance to help students correct mistakes.

- Reprimands, notifications to parents for coordination in helping students correct mistakes.

- Temporary suspension from school with the duration, implementing other education measures as prescribed by the Ministry of Education and Training.

*Note: In cases of non-compliance with student regulations, the school does not impose expulsion.

7 behaviors that students in Vietnam are prohibited from doing

Based on Article 37 of the Charter for lower secondary schools, upper secondary schools, and schools with multiple educational levels, promulgated along with Circular No. 32/2020/TT-BGDDT, the 7 behaviors that students are prohibited from doing include:

[1] Insulting the dignity, honor or infringing upon the body of teachers, school staff, others, and fellow students.

[2] Cheating in studying, exams, tests, enrollment.

[3] Buying, selling, using alcohol, beer, cigarettes, addictive substances, stimulants, fireworks, and explosive substances.

[4] Using mobile phones, or other electronic devices during class without the consent of teachers and if not serving the purpose of studying.

[5] Fighting, causing disturbance, or disrupting order and safety in the school and in public places.

[6] Using, exchanging cultural products with violent or obscene content; using toys or playing games that harm their healthy development.

[7] Violating other prohibited acts as stipulated by the law.
