What are regulations on the enrollment quota of universities in Vietnam?
According to the provisions of Clause 1, Article 34 of the Law on Higher Education 2012 (amended by Point a, Clause 19, Article 1 of the Amended Law on Higher Education 2018), the enrollment quotas of a university are stipulated as follows:
- Enrollment quotas are determined by fields and groups of fields of study based on the labor market demand, socio-economic development requirements, and are appropriate to the conditions of the number and quality of teachers, facilities, the employment rate of university graduates, and other quality assurance conditions;
- Universities themselves determine the enrollment quotas; publicly announce the enrollment quotas, training quality and the conditions to ensure training quality, and employment rates of graduates; ensure the output standards of the announced training programs;
- Universities that violate the regulations on the subjects, conditions, and enrollment quotas will be handled according to the law and will not be allowed to determine their enrollment quotas independently for a period of 05 years from the date of conclusion of the violation by the competent state agency.

What are the fines imposed on universities in Vietnam for violating enrollment regulations?
As per Article 8 of Decree 04/2021/ND-CP:
Violations of enrollment regulations
- A fine of between 10,000,000 VND and 20,000,000 VND will be imposed for one of the following acts:
a) Announcing enrollment, publishing the enrollment scheme that is incorrect or incomplete according to current legal regulations;
b) Announcing enrollment without meeting the time frame as prescribed by current law.
- A fine of between 20,000,000 VND and 30,000,000 VND will be imposed for one of the following acts:
a) Publishing enrollment quotas that exceed the quantity specified in the enrollment quota determination regulations;
b) Not following the enrollment process as prescribed by current law.
- A fine of between 30,000,000 VND and 40,000,000 VND will be imposed for one of the following acts:
a) Not announcing the minimum entry quality benchmark for fields of study that have such a requirement;
b) Conducting enrollment not in accordance with the published enrollment scheme.
A fine of between 40,000,000 VND and 60,000,000 VND will be imposed for organizing enrollment for fields, specialties, or foreign education programs without permission.
Additional penalty: Expelling foreigners who commit the violation described in Clause 4 of this Article.
Remedial measure: Forcing the transfer of students who meet the enrollment conditions to another educational institution that is permitted to operate, or cancelling the admission decisions and refunding the collected fees to the students if the transfer cannot be made for violations described in Clause 4 of this Article.
Point b, Clause 3, Article 3 of Decree 04/2021/ND-CP stipulates the fine levels as follows:

b) The fine levels stipulated in Chapter II of this Decree are applied to administrative violations committed by organizations, except for those specified in Clause 5, Article 9; Clause 2, Article 11; Clause 1 and Points a, b, c, d, e, Clause 3, Article 14; Point b, Clause 3, Article 21; Clause 1, Article 23; Clause 1, Article 29 of this Decree, which are the fine levels for administrative violations committed by individuals. For the same administrative violation, the fine level for individuals is half of that for organizations.

Thus, universities that violate the enrollment regulations will be penalized as follows:
- Announcing enrollment, publishing the enrollment scheme improperly or incompletely according to current regulations; announcing enrollment without meeting the time frame as prescribed by current law will be fined between 10,000,000 VND and 20,000,000 VND;
- Publishing enrollment quotas exceeding the quantity specified; not following the enrollment process as prescribed by law will be fined between 20,000,000 VND and 30,000,000 VND;
- Not announcing the minimum entry quality benchmark for fields that require it; conducting enrollment not in accordance with the published enrollment scheme will be fined between 30,000,000 VND and 40,000,000 VND;
- Organizing enrollment for fields, specialties, or foreign education programs without permission will be:
+ Fined between 40,000,000 VND and 60,000,000 VND;
+ Subject to additional penalty of expelling foreigners who commit the violation;
+ Subject to remedial measures, including forcing the transfer of eligible students to another permitted educational institution or canceling the admission decisions and refunding collected fees if the transfer cannot be made.
