What are regulations on the documentation and procedures of for transferring schools of first-grade students in Vietnam?

Pursuant to Article 36 of the Regulation on Primary Schools issued with Circular 28/2020/TT-BGDDT, the documentation and procedures of for transferring schools of first-grade students in Vietnam are regulated as follows:

(1) Student Transfer Documentation

The school with transferring students guides the completion and validates the legality of the dossier. The receiving school accepts and manages the dossier. The documentation includes:

- Application for school transfer by the parent or guardian of the student.

- Academic record.

- Information about learning materials (at the current school), program implementation progress, and a summary of the evaluation results of the student's training and learning.

- Individual education plan for students with disabilities (if any).

(2) Procedures for School Transfer

Step 1: The student's parent or guardian submits an application for school transfer to the receiving school through direct submission, via postal service, or online through the Public Service Portal (if available).

Step 2: Within no more than 03 working days from the date of receipt of the application, the principal of the receiving school will provide an opinion on whether to accept the student. If not accepted, the reason must be clearly stated on the application and returned to the parent or guardian via the method used for submission.

Step 3: Once agreed by the receiving school, the parent or guardian submits the school transfer application to the current school.

Within no more than 03 working days from the date of receipt of the application, the principal of the current school is responsible for returning the student's dossier as stipulated in Clause 1, Article 36 of the Regulation on Primary Schools issued with Circular 28/2020/TT-BGDDT.

Step 4: The parent or guardian submits the entire dossier stipulated in Clause 1, Article 36 of the Regulation on Primary Schools issued with Circular 28/2020/TT-BGDDT to the receiving school.

Step 5: Within no more than 03 working days from the date of receipt of the complete dossier, the principal of the receiving school organizes a meeting to exchange information, survey, counsel, and arrange the student into the class.

(3) Procedures for School Transfer for Primary School-Aged Students Returning from Abroad

Step 1: The student's parent or guardian submits an application to the receiving school through direct submission, via postal service, or online through the Public Service Portal (if available).

Step 2: Within no more than 03 working days from the date of receipt of the application, the principal of the receiving school will provide an opinion on whether to accept the student. If not accepted, the reason must be clearly stated on the application and returned to the parent or guardian via the method used for submission.

Step 3: In case of acceptance, within no more than 07 working days from the date of receipt of the application, the principal of the receiving primary school organizes an assessment of the student's level, arranges them into an appropriate class, and manages the student's dossier as required.

What are the duties of first-Grade students in Vietnam?

Pursuant to Article 34 of the Regulation on Primary Schools issued with Circular 28/2020/TT-BGDDT, the duties of primary school students include:

- To study and train according to the school's educational plan and rules; to be self-disciplined in studying and training to develop comprehensive qualities and abilities according to the goals of the primary education program.

- To fulfill fully and effectively learning tasks; to know how to self-study under the guidance of teachers; to actively and positively participate in experiential activities, applying learned knowledge to real-life situations; to exercise and maintain personal hygiene.

- To be filial to parents and grandparents; to respect and obey teachers and elders; to unite and love friends, younger siblings, the elderly, people with disabilities, and those with difficult circumstances.

- To comply with school rules, protect school and public property; to follow traffic safety regulations; to maintain hygiene and protect the environment.

- To contribute to activities promoting, protecting, and developing the school's and the local community's traditions.

What are the rights of first-grade students in Vietnam?

Pursuant to Article 35 of the Regulation on Primary Schools issued with Circular 28/2020/TT-BGDDT, the rights of primary school students include:

(1) To Be Educated

- To be educated and study to develop comprehensively and maximize their potential; to study in a school and class that implements the primary education curriculum conveniently accessible to the student in their residential area.

- Students can choose their school or transfer to another school outside their residential area if the school can accommodate them.

- Primary school-aged students returning from abroad, children of foreigners studying or working in Vietnam, children who have not had the opportunity to attend school due to challenging circumstances, if they wish to transfer to a primary school, the principal will organize an assessment to place them in an appropriate class.

- Students with disabilities are included in a primary school; they are ensured conditions for studying and training; they are taught and evaluated according to their individual education plan.

- Students can shorten the time to complete the program, study at an older age than the prescribed age, study for an extended time, or repeat a grade.

- Students with good physical and intellectual development can be considered for class advancement within the grade level.

The procedures for considering specific cases include the following steps:

Parents or guardians submit a request to the school.

The school principal establishes an advisory assessment council, including: the principal or vice-principal, representatives of the school's parent association, the student's current teacher, the teacher of the next grade, healthcare staff, and the team leader.

Based on the advisory council's assessment results, the principal finalizes the dossier and reports it to the head of the Department of Education and Training for a decision.

- Students with limited academic results who have been directly guided and helped by teachers and parents/guardians but still have not met the requirements, based on the extent of unmet learning and training tasks, the teacher reports to the principal for consideration, either promoting the student to the next grade or retaining them, and along with the family, deciding appropriate education measures.

(2) To Be Protected, Cared for, Respected, and Treated Equally and Democratically; to have their legitimate rights and interests ensured; to receive full information about their learning and training process; to have ensured conditions for time, facilities, hygiene, and safety for studying and training.

(3) To Participate in Activities that Develop Individual Abilities; to express personal opinions and desires.

(4) To Receive scholarships and social welfare policies as per regulations.

(5) To Enjoy other rights according to the law.
