What are purposes of visiting lecturers' activities in Vietnam? Is visiting lecturing activity of a public employee required to be concluded by an employment contract in Vietnam?

What is visiting lecturing activity in Vietnam?

Pursuant to Article 2 of the Regulations on policies for visiting lecturing activity in educational institutions issued together with Circular 44/2011/TT-BGDDT, visiting lecturing activity is when an educational institution invites teachers or individuals who meet the specified standards to perform the following activities:

- Teaching subjects and modules stipulated in preschool, general education, continuing education, vocational intermediate education, and higher education programs;

- Teaching specific topics;

- Guiding, participating in grading, and serving on thesis, capstone project, and graduation thesis defense panels; guiding and participating in master's thesis and doctoral dissertation evaluation panels;

- Guiding laboratory work, practical exercises, and internships according to educational programs;

- Involving in the development and enhancement of curricula, compiling teaching materials, and writing reference books.

What are purposes of visiting lecturers' activities in Vietnam?

Pursuant to Article 3 of the Regulations on policies for visiting lecturing activity in educational institutions issued together with Circular 44/2011/TT-BGDDT, the purposes of visiting lecturing activity activities are:

- Enhancing the quality of education and training through attracting highly qualified educators and scientists to participate in visiting lecturing activity at educational institutions.

- Contributing to creating conditions for full-time faculty at educational institutions to have time to perform scientific research tasks, technology transfer, practical immersion, learning, and professional development to enhance their qualifications.

What are the responsibilities of the visiting lecturing activity institution in Vietnam?

According to Article 10 of the Regulations on policies for visiting lecturing activity in educational institutions issued together with Circular 44/2011/TT-BGDDT, the visiting lecturing activity institution has 6 responsibilities:

- Developing and publicly announcing the visiting lecturing activity plan at the beginning of the academic year.

- Identifying individuals who meet the standards for visiting lecturing activity faculty and the institution's requirements, organizing the signing of visiting lecturing activity contracts. Publicly announcing the list of visiting lecturing activity faculty.

- Fulfilling the obligations of the visiting lecturing activity institution specified in the visiting lecturing activity contract. Facilitating the visiting lecturing activity faculty's use of the educational institution's equipment and means to perform the visiting lecturing activity contract.

- Implementing the regulations on managing and evaluating the quality of visiting lecturing activity activities.

- Certifying the results of the visiting lecturing activity contract. Informing the visiting lecturing activity faculty's employing agency or organization of the visiting lecturing activity contract performance results.

- Managing and storing visiting lecturing activity records.

Additionally, the visiting lecturing activity institution has the following rights:

- Being informed about the visiting lecturing activity faculty's work results, rewards, and disciplinary actions by the agency or organization employing the visiting lecturing activity faculty.

- The visiting lecturing activity faculty team is considered a human resource to determine the capacity of the visiting lecturing activity institution.

Is visiting lecturing activity of a public employee required to be concluded by an employment contract in Vietnam?

Pursuant to Article 7 of the Regulations on policies for visiting lecturing activity in educational institutions issued together with Circular 44/2011/TT-BGDDT:

Visiting lecturing activity contract

  1. For visiting lecturing activity faculty who are officials and public employees:

a) The visiting lecturing activity contract is a service or task contract. The signing, implementation, modification, and termination of the visiting lecturing activity contract are governed by the provisions of Section 7, Chapter XVII of the Civil Code. Employment contracts are not implemented for visiting lecturing activity activities of officials and public employees.

b) The visiting lecturing activity contract must include a clause in which the visiting lecturing activity faculty pledges to ensure they complete their duties at their employing institution.

  1. For visiting lecturing activity faculty who are not officials and public employees:

a) For the activities specified in points a, b, c, d of clause 1, Article 2 of these Regulations, the visiting lecturing activity contract is an employment contract as stipulated in the Labor Code. The signing, implementation, termination of the visiting lecturing activity contract, complaints, denunciations, and resolution of complaints, and denunciations are conducted following labor law regulations.

b) For the visiting lecturing activity activities specified at point e of clause 1, Article 2 of these Regulations, the visiting lecturing activity contract is a service or task contract. The signing, implementation, modification, and termination of the visiting lecturing activity contract are governed by the provisions of Section 7, Chapter XVII of the Civil Code.

Hence, employment contracts are not implemented for visiting lecturing activity activities of public employees.
