What are prohibited actions for grade 6 students in Vietnam?

Based on Article 37 of the Regulations on lower secondary schools, upper secondary schools, and multi-level schools issued in conjunction with Circular 32/2020/TT-BGDDT, the actions that grade 6 students are prohibited from doing include:

- Insulting the dignity or honor, infringing on the physical integrity of teachers, school staff, other students, and others.

- Cheating in studies, examinations, tests, and admissions.

- Buying, selling, or using alcohol, beer, tobacco, narcotics, other stimulants, fireworks, and explosive substances.

- Using mobile phones and other devices during classroom learning that are not for educational purposes and not permitted by the teacher.

- Fighting, causing disorder and insecurity in the school and public places.

- Using or exchanging cultural products with violent or obscene content; using toys or playing games harmful to healthy development.

- Students must not commit any other prohibited acts as prescribed by law.

Pursuant to Article 35 of the Regulations issued in conjunction with Circular 32/2020/TT-BGDDT, there are specific provisions regarding the rights of students as follows:

Rights of Students

1. Be treated equally in accessing comprehensive education, be assured of conditions such as time, facilities, hygiene, and safety to study in class and at home, be provided with information about their learning and training, be able to use equipment and facilities for educational, cultural, and sports activities of the school as prescribed.

2. Be respected and protected, treated equitably and democratically, have the right to complain to the school and higher educational management levels about decisions affecting themselves; have the right to transfer schools for justified reasons according to current regulations; study ahead of age, skip grades, or study at an age beyond the prescribed age according to Article 33 of these Regulations.

3. Participate in activities aimed at developing talents in various subjects, sports, and arts organized by the school if they meet the conditions.

4. Receive scholarships or other grants as prescribed for students under social policies, students with difficult living conditions, and students with exceptional abilities.

5. Transfer schools if meeting the conditions under regulations; the process for transferring schools is conducted as per regulations of the Minister of Education and Training.

6. Enjoy other rights as prescribed by law.

Therefore, according to the regulations, students have the right to study ahead of age, skip grades, and study at an age older than the prescribed age as per Article 33 of the Regulations issued alongside Circular 32/2020/TT-BGDDT. Hence, a grade 6 student is allowed to enroll at an age beyond 11 years.

Is a student in Vietnam considered the right age if they are 12 when admitted to grade 6?

Based on Article 33 of the Regulations issued in conjunction with Circular 32/2020/TT-BGDDT, the provisions regarding the age of secondary school students are as follows:

Age of Secondary School Students

1. The age for students entering grade 6 is 11. The age for students entering 10th grade is 15. For students who skip classes in the previous level or enter at an age higher than the prescribed age, the age for entering 6th and 10th grades can be adjusted based on the graduation year of the previous level.

2. Students who are ethnic minorities, with disabilities, under special difficult circumstances, or returning from abroad may enter a level of education up to 3 years older than the prescribed age.

3. Students cannot repeat a grade more than 3 times during one level.

4. Students with good physical health and early intellectual development may enter school ahead of their age or skip grades within the level. Consideration for each specific case is conducted as follows:

a) Parents or guardians submit a request to the school.

b) The principal establishes a survey and advisory council comprising key members: representatives from the school leadership and the school's parent council; teachers of the class the student is attending.

c) Based on the council's survey results, the principal makes a decision.

5. Students within the prescribed age abroad returning home, and children of foreigners working in Vietnam can study at local secondary schools or schools outside their residence if that school can accommodate them. Consideration for each specific case is conducted as follows:

a) Parents or guardians submit a request to the school.

b) The principal assesses the student's level and places them in the appropriate class.

Additionally, according to Clause 1 Article 28 of the Education Law 2019, the regulations regarding educational levels and ages of general education are as follows:

Educational Level and Age in General Education

1. The educational levels and ages in general education are regulated as follows:

a) Primary education is conducted over 5 school years, from grade one to five. Students entering grade one are 6 years old, calculated by year;

b) Lower secondary education is conducted over 4 school years, from grade six to nine. Students entering grade six must have completed primary education, and the entry age is 11 years old, calculated by year;

c) Upper secondary education is conducted over 3 school years, from grade ten to twelve. Students entering grade ten must have completed lower secondary education, and the entry age is 15 years old, calculated by year.

2. Instances for skipping grades or studying at a higher age than the prescribed age in clause 1 of this Article include:

a) Students skipping grades due to advanced intellectual development;

b) Students studying at a higher age than prescribed due to repeating classes, residing in areas with exceptionally difficult socio-economic conditions, being ethnic minorities, with disabilities, underdeveloped in physical capabilities or intellect, orphans without shelter, belonging to poor households, returning from abroad, and other cases as prescribed by law.

Therefore, according to the above regulations, a student who is 12 years old when admitted to grade 6 is still considered to be at the correct age if they fall into one of the following categories:

- Students repeating a grade

- Students who are ethnic minorities

- Students with disabilities

- Students under special difficult circumstances

- Students returning from abroad

- Students with underdeveloped physical or intellectual capabilities

- Orphans without shelter

- Students from poor households
