What are new regulations on investment conditions and operations in the field of education in Vietnam?

On October 5, 2024, the Government of Vietnam issued Decree 125/2024/ND-CP regulating investment conditions and operations in the education sector, replacing Decree 46/2017/ND-CP (amended and supplemented by Decree 135/2018/ND-CP).

Decree 125/2024/ND-CP stipulates the investment and operational conditions in the education sector, including:

- Establishment or permission to establish, operate educational activities, suspend educational activities, merge, divide, separate, dissolve for: Preschool educational institutions, general educational institutions, specialized schools;

- Establishment or permission to establish, suspend operations, merge, divide, separate, dissolve for: Continuous educational institutions, centers for development support of inclusive education;

- Establishment or permission to establish pedagogical colleges; issuance of certificates of vocational education activities for teacher training disciplines at the college level; suspension of vocational education activities for teacher training disciplines at the college level; revocation of vocational education activity registration certificates for teacher training disciplines at the college level; merger, division, separation, and dissolution of pedagogical colleges; merger of colleges into universities;

- Establishment or permission to establish universities, branches of higher education institutions; permission for universities, branches of higher education institutions to operate training; suspension of training activities of higher education institutions, branches of higher education institutions; merger, division, separation of higher education institutions; dissolution of higher education institutions, branches of higher education institutions; recognition of regional universities, national universities;

- Establishment or permission to establish, allow operation, suspend operations, dissolve quality education accreditation organizations of Vietnam; recognition of foreign educational quality accreditation organizations operating in Vietnam;

- Registration of study-abroad consulting services; suspension of study-abroad consulting services; revocation of business registration certificates for study-abroad consulting services.

Decree 125/2024/ND-CP comes into effect from November 20, 2024.

What are conditions for establishing private preschools from November 20, 2024 in vietnam?

According to Article 3 of Decree 125/2024/ND-CP, the conditions for establishing private preschools from November 20, 2024, include:

- Having a scheme to establish or permit the establishment of a preschool in accordance with the provincial planning and related local plans where the school is headquartered.

- The scheme should clearly define the objectives, tasks, programs, and content of preschool education; land, facilities, equipment, proposed construction site; organizational structure; resources and finance; strategic direction for building and developing the preschool.

Procedures for Establishing Private Preschools from November 20, 2024?

According to Clause 3, Article 4 of Decree 125/2024/ND-CP, the procedures for establishing private preschools from November 20, 2024, are as follows:

Step 1: Organizations and individuals submit one dossier as prescribed through the online public service portal, by post, or directly to the district-level People's Committee;

Step 2: Within 5 working days from the date of receiving a complete dossier, if the dossier is not valid, the district-level People's Committee will notify in writing the contents needing amendment to the agency, organization requesting the establishment or permission to establish the preschool; if the dossier is valid, the district-level People's Committee will instruct the Education and Training Department to assess the conditions for the establishment or permission of the preschool;

Step 3: Within 15 days from receiving the directive from the district-level People's Committee, the Education and Training Department will preside, cooperate with relevant specialized departments to assess the conditions for the establishment or permission of the preschool as per the dossier; prepare an assessment report to evaluate compliance; submit it to the Chairman of the district-level People's Committee for consideration and decision;

Step 4: Within 5 working days from the date of receiving the assessment report from the Education and Training Department, if the conditions are met, the Chairman of the district-level People's Committee decides to permit the establishment of the preschool; if the conditions are not met, a written notification detailing the reasons will be issued to the agency, organization, or individual requesting the establishment or permission to establish the preschool.
