In special urban areas, the area of the school construction land can be replaced by construction floor area, ensuring that it is not less than the minimum average land area per student as stipulated.

- Having sufficient financial resources to ensure the maintenance and development of educational activities:
+ For private primary schools, the investment level must be at least 50 million VND per student (excluding land use costs). The total investment capital must be calculated based on the time with the highest projected scale, and not less than 50 billion VND. The investment capital plan must suit the projected scale for each stage.
+ If a private primary school does not build new facilities but only rents or uses existing facilities to implement educational activities, the investment must reach at least 70% of the investment rate specified in point a of this paragraph;
+ For public primary schools, financial resources are guaranteed by the competent management agency to meet the requirements of the primary education program.
- Having a regulation on the organization and operation of the school.

Based on Article 19 of Decree 125/2024/ND-CP, a primary school in Vietnam will be suspended from educational activities in the following cases:
