Based on Article 15 of Decree 125/2024/ND-CP, the conditions for establishing a private primary school in 2024 are as follows:

- There must be a proposal for establishment or permission to establish a primary school that aligns with the provincial planning and relevant local plans where the school is headquartered.

- The scheme should clearly define the objectives, tasks, program and primary education content; land, facilities, equipment, prospective school construction site; organizational structure; financial and resource planning; strategic direction for building and developing the school.

What are conditions for allowing primary schools to operate in educational activities in Vietnam in 2024?

Based on Article 17 of Decree 125/2024/ND-CP, the conditions that allow a primary school to operate in education include:

- Possessing land, facilities, and equipment that meet the standards regarding location, scale, area and minimum facilities for primary schools as stipulated by the Ministry of Education and Training.

In special urban areas, the area of the school construction land can be replaced by construction floor area, ensuring that it is not less than the minimum average land area per student as stipulated.

- Having educational programs, teaching and learning materials that meet the requirements of the primary education curriculum as stipulated by the Ministry of Education and Training.

- Having a sufficient number of management staff, teachers, employees, and workers who meet the standards to organize educational activities in accordance with the primary education curriculum as stipulated by the Ministry of Education and Training.

- Having sufficient financial resources to ensure the maintenance and development of educational activities:

+ For private primary schools, the investment level must be at least 50 million VND per student (excluding land use costs). The total investment capital must be calculated based on the time with the highest projected scale, and not less than 50 billion VND. The investment capital plan must suit the projected scale for each stage.

+ If a private primary school does not build new facilities but only rents or uses existing facilities to implement educational activities, the investment must reach at least 70% of the investment rate specified in point a of this paragraph;

+ For public primary schools, financial resources are guaranteed by the competent management agency to meet the requirements of the primary education program.

- Having a regulation on the organization and operation of the school.

When is a primary school in Vietnam suspended from educational activities in 2024?

Based on Article 19 of Decree 125/2024/ND-CP, a primary school in Vietnam will be suspended from educational activities in the following cases:

- Committing fraud to obtain permission for educational activities;

- The person granting permission for educational activities is not authorized;

- Failing to begin educational activities within one year from the date of permission;

- Violating educational law provisions and being subject to administrative sanctions that require suspension of educational activities;

- Other violations as prescribed by law.

Does a private primary school in Vietnam have a school council?

Based on clause 2, Article 10 of the Charter of Primary Schools issued together with Circular 28/2020/TT-BGDDT, the regulation on the School Council in private primary schools is as follows:

- The school council of a private school is the school's management body, acting as a representative for the investor and stakeholders, responsible for organizing the implementation of the investor's decisions.

- The composition of the private school council involves representatives of domestic and foreign investors, members within and outside the school as elected by the investors' meeting and decided according to the capital contribution ratio.

The composition of the school council of a non-profit private school invested by domestic investors includes representatives elected by investors based on their capital contribution ratio; internal and external members.

Internal members include the standing members such as the party secretary, the chairman of the Trade Union, the representative of the Communist Youth Union, the principal; elected members are teachers and workers selected by the school's general or delegate meeting. External members include leaders, educators, entrepreneurs, alumni as selected by the school's general or delegate meeting.

- The duties, powers, establishment procedures, and activities of the private primary school council are implemented following the Organizational and Operational Regulation of primary, secondary, and high schools, and multi-level private schools.

Private primary schools have a School Council, which represents the investor and stakeholders, and is responsible for organizing and implementing the investor's decisions.
