Students undergoing formal undergraduate training at higher education institutions are eligible for postponement of military service as stipulated in point g, clause 1, Article 41 of the 2015 Military Service Law.

Who has authority to postpone military service for higher education in Vietnam?

Article 42 of the 2015 Military Service Law outlines the authority to decide on the postponement, exemption, and recognition of the completion of active military service as follows:

  1. The Chairman of the District People’s Committee decides on the postponement and exemption from military service for citizens specified in Article 41 of this Law.
  1. The Commander of the District Military Command decides to recognize the completion of active military service for citizens specified in clause 4, Article 4 of this Law.

Thus, the Chairman of the District People’s Committee has the authority to allow students to postpone military service for higher education in Vietnam.

Can a College Admittance Defer Military Service until After Enrollment?

Article 10 of the University and College Admissions Regulation for Preschool Education, issued together with Circular 08/2022/TT-BGDDT, stipulates the following:

Retention of Admission Results

  1. Candidates who have received an admission notice can retain their admission results in the following cases:

a) Participating in military service or youth volunteer service immediately in the year of admission according to the decision or order of competent authorities;

b) Suffering from serious illness or a severe accident that prevents timely enrollment, with medical records and acknowledgment from competent medical authorities.

  1. Candidates falling under the provisions of clause 1 must send a retention application along with supporting documentation to the training institution calling for enrollment. The maximum retention period is determined by the training institution, but not less than 3 years for those specified in point a, clause 1 of this Article.
  1. Immediately after meeting conditions to resume studies, the retained candidates must complete enrollment procedures as required by the training institution, providing evidence of having fulfilled military duties or recovered from illness. For those granted retention of 3 years or more, the training institution may consider recommending preparatory classes before official enrollment.

Under Article 43 of the 2015 Military Service Law:

Conditions for Discharge

  1. Non-commissioned officers and soldiers who have completed the active service term as stipulated in clauses 1 and 2, Article 21 of this Law shall be discharged.

  2. Non-commissioned officers and active-duty soldiers can be discharged early when concluded by the Military Medical Examination Council to be unfit for continued service or in cases specified in points b and c, clause 1, and points a, b, and c, clause 2, Article 41 of this Law.

According to Article 21 of the 2015 Military Service Law, the active service term for non-commissioned officers and soldiers is as follows:

  1. The peacetime active service term for non-commissioned officers and soldiers is 24 months.

  2. The Minister of National Defense may decide to extend the active service term for non-commissioned officers and soldiers by no more than 6 months in the following cases:

a) To ensure combat readiness;

b) While performing natural disaster, disease prevention, rescue, and relief duties.

  1. The active service term for non-commissioned officers and soldiers during wartime or a national defense emergency is enacted based on a general or partial mobilization order.

Thus, college admittance who pursues military service can retain their admission results for a minimum of 3 years.

After completing military service and being discharged, the college admittee must follow enrollment procedures as stipulated by the training institution.

For retention periods of 3 years or more, the training institution may recommend preparatory classes before official enrollment.
