Pursuant to Clause 4, Article 2 of the 2010 Law on Persons with Disabilities:

Interpretation of terms

In this Law, the following terms are construed as follows:

  1. A person with a disability is a person who has a defect in one or more body parts or has a functional impairment manifesting in a disability causing difficulty in work, daily activities, and learning.
  1. Discrimination against persons with disabilities is the attitude of disdain or disrespect for persons with disabilities due to their disability.
  1. Discriminatory practice against persons with disabilities is the act of alienating, rejecting, mistreating, defaming, prejudicing, or limiting the rights of persons with disabilities due to their disability.

4. Inclusive education is the educational method in which persons with disabilities are educated together with persons without disabilities in an educational institution.

  1. Specialized education is the educational method exclusively for persons with disabilities in an educational institution.

Pursuant to Article 5 of Circular 03/2018/TT-BGDDT, the duties and powers of an educational institution implementing inclusive education are as follows:

- Detect, mobilize, and admit persons with disabilities to study at the educational institution.

- Arrange and organize classes suitable for persons with disabilities; ensure that each inclusive class has no more than 02 (two) persons with disabilities.

In special cases, the head of the educational institution may, based on actual conditions, arrange and organize more persons with disabilities in one class to ensure that those who need inclusive education are all able to attend.

- Develop and implement early intervention activities, inclusive education plans; provide counseling and career orientation suitable to the needs and abilities of persons with disabilities.

- Build an inclusive, friendly educational environment that ensures persons with disabilities are respected, supported, and cooperate and participate equally in all educational activities.

- Coordinate with families, communities, inclusive education support centers, and specialized educational institutions to implement inclusive education.

- Support the implementation of early intervention activities and basic skill development for persons with disabilities to integrate into the community.

- Provide information about the education of persons with disabilities currently studying inclusively at the educational institution to the district-level disability determination council.

- Develop professional competencies for management staff, teachers, lecturers, and employees to meet the tasks of inclusive education.

- Mobilize human resources to support inclusive education and use the state budget allocated for performing the tasks of inclusive education according to legal regulations.

What are the duties and rights of teachers and lecturers in inclusive educational institutions in Vietnam?

* Duties of teachers and lecturers

Pursuant to Article 11 of Circular 03/2018/TT-BGDDT, the duties of teachers and lecturers in an inclusive educational institution are as follows:

In addition to performing the duties prescribed for educators, teachers, and lecturers participating in inclusive education shall perform the following duties:

- Respect and implement the rights of persons with disabilities.

- Maintain confidentiality of information regarding the disability status of individuals and families of persons with disabilities.

- Coordinate with education support staff and the families of persons with disabilities to develop individual education plans for students with disabilities; organize educational activities and evaluate educational outcomes according to the individual plans of students with disabilities.

- Detect and propose solutions to address issues arising during the implementation of inclusive education.

- Provide counseling to persons with disabilities and their families about support services, early intervention, inclusive education, and vocational orientation suitable to their abilities and needs.

- Cooperate with colleagues, families, and related organizations or individuals to build a friendly and inclusive educational environment for persons with disabilities.

- Constantly self-upgrade, innovate methods, and learn experiences to improve the effectiveness of inclusive education.

* Rights of teachers and lecturers

Pursuant to Article 12 of Circular 03/2018/TT-BGDDT, the rights of teachers and lecturers in an inclusive educational institution are as follows:

In addition to the rights prescribed for educators, teachers, and lecturers participating in inclusive education shall enjoy the following rights:

- Receive training, professional development, and improvement in inclusive education.

- Have field trips and learning experiences in inclusive education.

- Receive commendations for outstanding achievements in inclusive education.

- Enjoy preferential policies in inclusive education according to current regulations.

What are objectives of inclusive education in Vietnam?

Pursuant to Article 3 of Circular 03/2018/TT-BGDDT, the objectives of inclusive education are as follows:

- Persons with disabilities develop their abilities, integrate and increase opportunities to contribute to the community.

- Ensure the right to equitable, quality education appropriate to the characteristics and abilities of persons with disabilities.
