According to Article 86 of Decree 125/2024/ND-CP, the conditions for allowing the establishment of a private pedagogical college in Vietnam are specified as follows:
(1) There must be a proposal for establishment or permission to establish a college in line with the approved planning of the higher education and teacher training network.
(2) The land area for constructing the main campus must be at least 02 hectares in urban areas or 04 hectares in rural areas.
The construction site of the college must ensure an educational environment that is safe for learners, teachers, management staff, and employees; it should not be located near service facilities, production facilities, or warehouses that cause environmental pollution, are harmful, have a direct risk of fire and explosion, and must not be in hazardous alert zones.
(3) Investment capital for college construction must be legal and identified in cash and assets prepared for investment, not including land value, and must ensure a minimum of 100 billion VND.
Public college construction investment must be approved by the competent management agency, clearly determining the funding sources for implementation in accordance with the plan, while private college construction investment must be certified by the competent authority or organization.
What are procedures for granting permission to establish a private pedagogical college in Vietnam?
According to Article 87 of Decree 125/2024/ND-CP, the procedures for granting permission to establish a private teacher training college are as follows:
(1) The Minister of Education and Training decides on the establishment of a public teacher training college or allows the establishment of a private teacher training college.
(2) The application dossier includes:
- The proposal for the establishment of a public teacher training college from the competent management authority or the proposal for establishing a private teacher training college from the organization or individual (according to Form No. 01 Appendix 2 attached to Decree 125/2024/ND-CP);
- Approval document from the provincial People's Committee where the college's main campus is located (except for colleges under the provincial People's Committee);
- Scheme for establishment or permission to establish a teacher training college (according to Form No. 02 Appendix 2 attached to Decree 125/2024/ND-CP);
- Draft overall site planning and preliminary design of construction projects, ensuring suitability with the training discipline, scale, level of training, and standard area of use, and building area for learning and teaching;
- A copy of legal documents proving land use rights, house ownership, or approval document for land allocation or lease for college construction from the provincial People's Committee, along with proof of completed financial obligations related to the land as regulated.
Copies of the lease contract for facilities attached to the land with a duration of at least 05 years from the date of dossier submission in cases of renting facilities connected to the land, along with a copy of legal documents proving the usage or ownership rights of the lessor;
- A copy of the approval document on investment policy, investment decision, or approved documents for public investment plan or investment completion settlement approved by the competent management agency for public college establishment proposals;
Bank confirmation documents on the capital contribution in the investor's account, proof of asset ownership along with asset valuation documents if contributing capital with assets or ownership rights for proposals to establish a private college;
- For private colleges, the dossier must also include a document on founding members and capital contribution to establish the college (according to Form No. 03 Appendix 2 attached to Decree 125/2024/ND-CP).
(3) Implementation process:
Step 1: Agencies, organizations, or individuals submit 01 set of application documents specified in (2) via online public service portal, postal service, or directly to the Ministry of Education and Training;
Step 2: Within 05 working days from the date of receiving sufficient documents, if the documents are invalid, the Ministry of Education and Training will notify in writing the contents that need to be amended or supplemented to the agencies, organizations, or individuals; if the documents are valid, the Ministry of Education and Training organizes the appraisal of the conditions for establishing the college;
Step 3: Within 10 days from the date of receiving valid documents, the Minister of Education and Training coordinates the appraisal of the conditions for college establishment; prepares an appraisal report to evaluate compliance with the provisions of Article 86 of Decree 125/2024/ND-CP;
Step 4: Within 10 days from the date of the appraisal report, if conditions are met, the Minister of Education and Training will decide to establish a public teacher training college or allow the establishment of a private teacher training college; if conditions are not met, the ministry will notify the agency, organization, or individual in writing, stating the reasons.
The decision to establish a public teacher training college or allow the establishment of a private teacher training college (according to Form No. 10 Appendix 2 attached to Decree 125/2024/ND-CP) will be sent to the provincial People's Committee where the college's main campus is located and publicly announced on mass media.
