According to the provisions of Article 17 Decree 86/2021/ND-CP, the standards for lecturers of higher education institutions assigned to teach, conduct scientific research, and exchange academics abroad are as follows:
- Having good political and ethical qualities.
- Not being disciplined or prosecuted for criminal liability.
- Having qualifications and capabilities suitable for the content and program of teaching, scientific research, and academic exchanges abroad.
- Meeting other requirements of the program of teaching, scientific research, and academic exchanges abroad.
- Having the agreement of the higher education institution to be sent abroad.

What are the rights and responsibilities of lecturers of higher education institutions in Vietnam when assigned to go abroad?
Based on Article 19 Decree 86/2021/ND-CP, the rights and responsibilities of lecturers assigned to go abroad for teaching, scientific research, and academic exchanges are as follows:
- Regarding rights:
+ To be protected by the Vietnamese representative agency abroad regarding their legal rights and interests in accordance with Vietnamese law, the law of the host country, and international law and practice, during the period of teaching, research, and academic exchange abroad;
+ To remit salaries, wages, income, and other personal assets home in accordance with Vietnamese law and the law of the host country;
+ In the case of individuals affiliated with state-funded agencies or organizations, to receive salaries, wages, other income, health care policies, social insurance, and other benefits based on an agreement with the direct managing agency and to be reinstated to their position upon completing their work abroad.
- Regarding responsibilities:
+ To abide by the decision to go abroad for teaching, scientific research, and academic exchanges;
+ To strictly comply with the laws of Vietnam and the host country; to register as Vietnamese citizens abroad in accordance with current regulations;
+ To pay social insurance, health insurance, personal income tax (if any), and other mandatory fees as required by current state regulations; in case an international treaty which Vietnam has signed or acceded to has provisions on personal income tax different from current Vietnamese tax laws, to comply with the international treaty;
+ To protect documents and information containing state secrets as stipulated in the Law on Protection of State Secrets, ensuring the protection of internal political information;
+ Not to use teaching or professional activities as a pretext to engage in activities that oppose the Vietnamese state or affect diplomatic relations between Vietnam and the host country;
+ Not to violate regulations on scientific and technological activities of Vietnam and the host country; not to violate current laws on the duties and responsibilities of educators which affect the image and reputation of Vietnam in the host country;
+ To work at the assigned location; to strictly adhere to workplace regulations; to return to Vietnam after completing the program of teaching, scientific research, and academic exchanges in accordance with the host country's regulations;
+ Not to take advantage of teaching, scientific research, and academic exchanges abroad to pursue unlawful labor or stay abroad illegally, except in cases where an extended stay abroad is warranted due to illness, war, natural disasters, or epidemics;
+ To fulfill agreements and commitments with the direct managing agency and the competent authority that assigned the individual to teach, conduct scientific research, and exchange academics abroad (if any);
+ To follow current regulations for officials and public employees and the rules of the Communist Party (for officials, public employees, and Party members);
+ To report to the direct managing agency every three months.
What are the rights and responsibilities of higher education institutions in Vietnam in assigning lecturers to go abroad for teaching, scientific research, and academic exchanges?
Based on Article 20 Decree 86/2021/ND-CP, the rights and responsibilities in assigning lecturers abroad for teaching, scientific research, and academic exchanges are as follows:
- Regarding rights:
+ To exercise rights related to international cooperation as stipulated in Article 44 Law on Higher Education 2012 and Article 71 Law on Science and Technology 2013;
+ To organize recruitment, selection, training, and assignment of individuals for teaching, scientific research, and academic exchanges abroad;
+ To require individuals assigned for teaching, scientific research, and academic exchanges abroad to adhere to institutional regulations or agreements before going abroad (if any);
+ To require individuals assigned for teaching, scientific research, and academic exchanges abroad to report their work results during their stay abroad.
- Regarding responsibilities:
+ To select individuals with the right political, ethical qualities, capabilities, and professional standards for teaching, scientific research, and academic exchanges abroad;
+ To monitor the working process of those assigned abroad for teaching, scientific research, and academic exchanges, and to reinstate them to their positions upon completing their programs abroad;
+ To report the assignment of individuals for teaching, scientific research, and academic exchanges abroad to the competent authority (if any) and as per the provisions of Article 28 Decree 86/2021/ND-CP.
