What are conditions for the Center for Inclusive Education Support and Development to operate educational activities in Vietnam?
Based on Article 62 of Decree 46/2017/ND-CP (amended by Clause 25, Article 1 of Decree 135/2018/ND-CP), the conditions for the inclusive education support and development center to operate educational activities are as follows:
(1). Having physical facilities, means, equipment, and support services appropriate to the characteristics of people with disabilities, including:
- Headquarters, offices for management staff, teachers, and employees;
- Classrooms, functional rooms corresponding to the center's activities;
- Dormitory area for students in centers with boarding people with disabilities;
- Means, equipment, and tools used for assessment, intervention, teaching, vocational training and guidance;
- Professional documents and support materials ensuring the implementation of the center's activities.
(2). The team of educators, teachers, and support staff must have appropriate professional qualifications for the educational methods of people with disabilities.
(3). The educational content, programs, and consulting materials must be suitable for the educational methods of people with disabilities.

What are the procedures for an inclusive education support and development center to operate educational activities in Vietnam?
Based on Article 62 of Decree 46/2017/ND-CP (amended by Clause 26, Article 1 of Decree 135/2018/ND-CP), the procedures for the inclusive education support and development center to operate educational activities are as follows:
Procedures for the inclusive education support and development center to operate educational activities
- The Director of the Department of Education and Training permits the inclusive education support and development center to operate educational activities.
- The dossier includes:
a) A written request for permission to operate educational activities, specifying the conditions to meet the activities corresponding to the tasks;
b) A copy issued from the original register, an authenticated copy from the original, or a copy accompanied by the original for comparison, of the establishment decision or the decision allowing the center's establishment.
- Implementation sequence:
a) The center sends directly or by postal service 01 set of the dossier prescribed in Clause 2 of this Article to the Department of Education and Training;
b) Within 20 working days from the date of receipt of a complete and valid dossier, the Department of Education and Training is responsible for organizing the appraisal of the operational conditions and deciding to allow the center to operate educational activities. If permission is not granted, a written notice specifying the reasons and solutions will be sent to the center.
Thus, the procedures for an inclusive education support and development center to operate educational activities are as follows:

What are cases of suspension of an inclusive education support and development center in Vietnam?
Based on Clause 1, Article 65 of Decree 46/2017/ND-CP, the suspension of operations of an inclusive education support and development center is prescribed as follows:
Suspension of operations of the inclusive education support and development center
- The inclusive education support and development center is suspended from operations when one of the following cases occurs:
a) Failing to ensure the conditions specified in Article 62 of this Decree;
b) Committing fraudulent acts to be established, to operate educational activities;
c) The person who granted permission for establishment or operation in education did not have the authority;
d) Failing to commence educational activities within 01 year from the date of permission to operate educational activities;
e) Violating legal provisions and being penalized with administrative fines at the suspension level;
f) Other violations as prescribed by law.

Thus, the inclusive education support and development center will be suspended in the following cases:
- Failing to ensure the educational operational conditions;
- Committing fraudulent acts to be established or operate educational activities;
- Being granted permission for establishment or operation in education without proper authority;
- Failing to commence educational activities within 01 year from the date of permission to operate educational activities;
- Violating legal provisions and being penalized with administrative fines at the suspension level;
- Other violations as prescribed by law.
