Based on Article 6 of Decree 101/2017/ND-CP, the conditions for postgraduate training are as follows:

Conditions for Postgraduate Training

  1. For officials:

a) Have at least 03 years of working experience (excluding probation time) and have successfully completed their tasks for 02 consecutive years immediately prior to the time of being selected for training;

b) Be under 40 years old at the time of being selected for postgraduate training for the first time;

c) Commit to fulfilling duties at the agency or unit after completing the training program for a period of at least twice the training duration;

d) The training major must be suitable for the job position.

2. For public employees:

a) Have completed the probation period (if any);

b) Commit to fulfilling professional duties at the agency or unit after completing the training program for a period of at least twice the training duration;

c) The training major must be suitable for the job position.

  1. Officials and public employees selected to study under international cooperation programs signed or joined in the name of the State or the Government of the Socialist Republic of Vietnam, in addition to the provisions in clauses 1 and 2 of this Article, must also meet other requirements of the cooperation program.

Thus, teachers selected for postgraduate training must meet the following conditions:

- Have completed the probation period;

- Commit to fulfilling duties and professional activities at the agency or unit after completing the training program for a period of at least twice the training duration;

- The training major must be suitable for the job position.

When are teachers in Vietnam selected for postgraduate training required to reimburse training costs?

Based on Article 7 of Decree 101/2017/ND-CP, the provisions for reimbursing training costs are as follows:

Reimbursement of Training Costs

Officials and public employees selected for training from the intermediate level upwards using state budget funds or the financial resources of the managing or employing agency must reimburse training costs under one of the following circumstances:

  1. Voluntarily dropping out of the training, abandoning the job, or unilaterally terminating the employment contract during the training period.
  1. Not being awarded a graduation diploma by the training institution.
  1. Having completed the training and been awarded a graduation diploma but abandoning the job or unilaterally terminating the employment contract before fulfilling the committed service period according to Articles 5 or 6 of this Decree.

Thus, teachers selected for postgraduate training are required to reimburse training costs in the following situations:

- Voluntarily dropping out of the training, abandoning the job, or unilaterally terminating the employment contract during the training period;

- Not being awarded a graduation diploma by the training institution;

- Having completed the training and been awarded a graduation diploma but abandoning the job or unilaterally terminating the employment contract before fulfilling the committed service period of at least twice the training duration.

How much training cost must teachers in Vietnam selected for postgraduate training who do not receive a graduation diploma reimburse?

Based on Article 8 of Decree 101/2017/ND-CP, the provisions on reimbursement costs and calculation methods are as follows:

Reimbursement Costs and Calculation Methods

  1. Reimbursement costs include tuition fees and all other expenses serving the course, excluding salary and allowances (if any).
  1. Methods of calculating reimbursement costs:

a) For cases specified in clauses 1 and 2 of Article 7 of this Decree, officials and public employees must repay 100% of the reimbursement costs;

Thus, teachers selected for postgraduate training who do not receive a graduation diploma are required to repay 100% of the reimbursement costs. Reimbursement costs include tuition fees and all other expenses serving the course, excluding salary and allowances (if any).

How long do teachers in Vietnam selected for postgraduate training have to reimburse the training costs?

Based on Article 14 of Decree 101/2017/ND-CP, the provisions on repayment and recovery of reimbursement costs are as follows:

Repayment and Recovery of Reimbursement Costs

  1. No later than 120 days from the date of receiving the decision on reimbursement of training costs from the competent authority, the person responsible for reimbursement must repay the full reimbursement costs.
  1. Reimbursement costs must be paid to the agency or unit that covered the course expenses.
  1. In case of disagreement over reimbursement of training costs, the parties involved have the right to file a complaint or lawsuit in accordance with the law.

Thus, within 120 days from the date of receiving the decision on reimbursement of training costs from the competent authority, teachers selected for postgraduate training are required to reimburse the training costs. Reimbursement costs must be paid to the agency or unit that covered the course expenses.

Additionally, in cases of disagreement over reimbursement of training costs, the parties involved have the right to file a complaint or lawsuit in accordance with the law.
