What are conditions for secondary schools to operate educational activities in Vietnam?

Based on Article 27 of Decree 46/2017/ND-CP (amended by Clause 15, Article 1 of Decree 135/2018/ND-CP), the conditions for a secondary school to operate educational activities are as follows:

(1). There must be a decision to establish or permit the establishment by the competent authority prescribed in Clause 1, Article 26 of Decree 46/2017/ND-CP.

(2). There must be land, facilities, and equipment meeting the requirements for educational activities. Facilities include:

- Classrooms built according to standards, with sufficient desks and chairs suitable for students’ stature, teachers’ desks and chairs, a whiteboard, and ensuring the maximum of two shifts in one day;

- Subject-specific classrooms: Implement regulations on standards for subject-specific classrooms issued by the Minister of Education and Training;

- Learning support block including multi-purpose halls, libraries, activity rooms for the Communist Youth Union, traditional rooms;

- Administrative block: Principal’s office, Vice Principal’s office, general office, meeting room for all staff, specialty groups rooms, school healthcare room, storage room, security room, rooms for Communist Party organizations and other unions;

- Playgrounds and practice fields: With an area of at least 25% of the total land area, equipped with sufficient exercise and sports equipment ensuring safety;

- Parking area: Reasonably arranged within the school grounds, ensuring safety, order, and cleanliness;

- An information technology infrastructure system connected to the internet meeting the requirements for management and teaching.

(3). The school location must ensure an educational environment, safety for students, teachers, officials, and staff. The school must be a separate area with a surrounding wall, a school gate, and a school nameplate.

(4). There must be an educational program and teaching, learning materials compliant with regulations suitable for each educational level.

(5). There must be a team of teachers and management staff meeting the standards for morality and suitable qualification levels for each educational stage; sufficient in number according to the teacher structure type, ensuring the implementation of the education program and organization of educational activities.

(6). There must be sufficient financial resources as regulated to ensure maintaining and developing educational activities.

(7). There must be regulations on the organization and operation of the school.

* Secondary schools include lower secondary schools, upper secondary schools, and multi-level schools.

What are the procedures for a secondary school to operate educational activities in Vietnam?

Based on Article 28 of Decree 46/2017/ND-CP (amended by Clause 16, Article 1, and Article 2 of Decree 135/2018/ND-CP), the procedures for a secondary school to operate educational activities are as follows:

Step 1: The public secondary school or representatives of the organization or individual for private secondary schools shall submit directly or by post one set of documents to the competent authority (Head of the Department of Education and Training for lower secondary schools and Director of the Department of Education and Training for upper secondary schools).

The dossier includes:

- A written request for permission to operate educational activities;- A certified copy, or a copy from the original book, or a copy with the original for comparison of the decision to establish or permit the establishment of the school;

Step 2: The competent authority receives the dossier. If the dossier is unsatisfactory, a written notice specifying the required amendments and supplements is sent to the school within 5 working days from the date of receipt of the dossier.

Step 3: Within 20 working days from the date of receipt of a complete and valid dossier, the competent authority organizes the dossier appraisal and practical appraisal of the conditions for the school's educational activities; if qualified, they issue a decision allowing educational activities. If not, a written notice is sent to the school stating reasons and solutions.

When shall educational activities be suspended at a secondary school in Vietnam?

According to Clause 1, Article 30 of Decree 46/2017/ND-CP, the suspension of educational activities of a secondary school is carried out in the following cases:

- Fraudulent activities to obtain permission for educational activities;

- Failure to meet one of the conditions for permission for educational activities as stipulated in Article 27 of Decree 46/2017/ND-CP;

- The person granting permission for educational activities does so without authority;

- Failure to initiate educational activities within 1 year from the date of permission for educational activities;

- Violations of educational laws subject to administrative penalty requiring suspension;

- Serious violations of regulations on objectives, planning, educational quality, professional regulations, examination regulations;

- Other violations as prescribed by law.
