To establish a public primary school, a proposal must be submitted that aligns with the education network planning approved by competent state authorities, meets the socio-economic development needs of the local area, and facilitates children attending school to ensure the implementation of universal primary education.
This establishment proposal should clearly identify the objectives, tasks, educational programs, facilities, equipment, location, and land area proposed for school construction; organizational structure, resources, and finance; strategic directions for the construction and development of the school.

What are the procedures for establishing a public primary school in Vietnam?
According to Article 8 of the Charter of Primary Schools issued with Circular 28/2020/TT-BGDDT:
Conditions and procedures for establishment; conditions for educational activities; merger, division, suspension of activities, dissolution of primary schools and other educational institutions
1. Conditions and procedures for the establishment of public primary schools, permission to establish private primary schools; conditions and procedures for primary schools to engage in educational activities; merger, division of primary schools; suspension of educational activities for primary schools; dissolution of primary schools shall be in accordance with the regulations of the Government of Vietnam on investment conditions and activities in the field of education.
2. Conditions and procedures for other educational institutions to implement primary education programs; suspension, revocation of permission for other educational institutions to implement primary education programs shall be in accordance with the regulations of the Government of Vietnam on investment conditions and activities in the field of education.
3. Conditions for primary schools and other educational institutions implementing primary education programs to operate must meet the minimum standards according to current regulations.
According to Article 16 of Decree 46/2017/ND-CP amended by Clause 8, Article 1 of Decree 135/2018/ND-CP, the procedures for establishing a public primary school are as follows:
- The People's Committee of the commune for public primary schools shall directly or by post submit 01 dossier prescribed in Clause 2, Article 16 of Decree 46/2017/ND-CP to the Department of Education and Training;
- The Department of Education and Training receives the dossier. Within 05 working days from the date of receipt of the dossier, if the dossier is unsatisfactory, they shall notify in writing the contents that need to be corrected or supplemented to the organization or individual.
Within 15 working days from the date of receipt of a complete and valid dossier, the Department of Education and Training shall lead, cooperate with relevant specialized departments to appraise the dossier and actual conditions for the establishment of the primary school.
If the conditions are met, the Head of the Department of Education and Training shall provide a written opinion and send the dossier requesting the establishment or permission for the establishment of the school to the district-level People's Committee;
- Within 05 working days from the date of receipt of a complete and valid dossier, the Chairman of the district-level People's Committee shall decide on the establishment or permission to establish the school.
If the establishment or permission for the establishment is not granted, a written notification stating the reasons shall be sent to the Department of Education and Training, the People’s Committee of the commune, and the organization or individual requesting the establishment of the school.
- After a period of 02 years from the date the decision on the establishment or permission to establish comes into effect, if the primary school is not permitted to operate in education, the Department of Education and Training shall report to the Chairman of the district-level People's Committee for a decision to annul the decision on the establishment or permission to establish the school.
