Based on Article 75 of Decree 125/2024/ND-CP, the conditions for establishing public schools of arts, physical education, and sports in Vietnam are as follows:

- There must be a proposal for the establishment or authorization to establish the specialized school that aligns with the provincial planning and relevant local plans where the school's headquarters will be located.

- The establishment or authorization scheme must clearly identify the objectives, missions, educational program, and content; land, facilities, equipment, proposed school location, organizational structure, resources, and finances; the strategic direction for building and developing the school to achieve the objectives, missions of the specialized school in arts, sports, and physical education.

According to Article 76 of Decree 125/2024/ND-CP, the procedures for establishing a public school of arts, physical education, and sports in Vietnam are stipulated as follows:

(1) The Chairman of the Provincial People's Committee decides on the establishment or permits the establishment of a specialized school for arts, sports, and physical education within the province.

(2) Prepare the dossier which includes:

- A submission proposing the establishment or authorization to establish the school (according to Form No. 01 Appendix I attached to Decree 125/2024/ND-CP);

- The establishment or authorization scheme (according to Form No. 02 Appendix I attached to Decree 125/2024/ND-CP).

(3) Implementation order:

+ Step 1: The Department of Education and Training (for the establishment of a public specialized school for arts, sports, and physical education) submits one set of dossiers online through the public service portal, by post, or directly to the Provincial People's Committee where the school is headquartered;

+ Step 2: Within 5 working days from the date of receiving a complete dossier, if the dossier is not valid, the Provincial People's Committee shall notify in writing the required contents to be amended or supplemented to organizations, individuals; if the dossier is valid, the Provincial People's Committee organizes appraising the conditions for establishing the school;

+ Step 3: Within 20 days from the date of receiving a valid dossier, the Provincial People's Committee appraises the conditions for establishment or authorization to establish the school based on the dossier; prepares an appraisal report to evaluate the compliance with the provisions of Article 75 of Decree 125/2024/ND-CP;

+ Within 5 working days from the date of having the appraisal report, if conditions are met, the Chairman of the Provincial People's Committee decides on the establishment or authorization to establish the school; if conditions are not fully met, a written notice is issued to organizations, individuals requesting establishment or authorization, clearly stating the reasons.

The decision on establishment or authorization to establish the specialized school for arts, sports, and physical education (according to Form No. 10 Appendix I attached to Decree 125/2024/ND-CP) is publicly announced on mass media.

When is a specialized school for arts, sports, and physical education allowed to conduct educational activities in Vietnam?

As stipulated in Article 77 of Decree 125/2024/ND-CP, a specialized school for arts, sports, and physical education is allowed to conduct educational activities when meeting the educational operation conditions applicable to each educational level as prescribed in Article 17, Article 27 of Decree 125/2024/ND-CP, along with the following conditions:

- Having a sufficient number of qualified teachers, trainers to train in arts, sports, physical education:

+ Trainers of specialized sports schools must have a university degree in sports training or physical education or higher, hold a trainer certificate issued by competent authorities, and meet the conditions and standards to teach, coach according to the specialization of each sport;

+ Art teachers of specialized art schools must have a university degree suitable for the teaching specialization.

- Having a team of doctors or bachelors in sports medicine qualified to treat injuries, restore health for students.

- Having adequate facilities and suitable equipment for students to practice and compete in specialized arts, sports, physical education; providing dormitory for students; having kitchen, dining hall; having a medical room that meets the standards for initial health care and treatment for students.

Will a specialized school for arts, sports, and physical education in Vietnam be suspended if it does not start educational activities within a year?

Based on point a, clause 1, Article 79 of Decree 125/2024/ND-CP:

Suspension of Educational Activities; Merger, Division, Dissolution of Specialized Schools for Arts, Sports, and Physical Education

  1. Suspension of educational activities:

a) A specialized school for arts, sports, and physical education is suspended from educational activities in cases specified in clause 1 Article 29 of this Decree;

b) The Director of the Department of Education and Training decides to suspend educational activities for local public and private specialized schools for arts, sports, and physical education; the Minister, Head of a ministerial-level agency decides on the suspension of educational activities for specialized schools for arts, sports, and physical education under ministries and central authorities;

Simultaneously, according to clause 1, Article 29 of Decree 125/2024/ND-CP, regulations regarding the suspension of secondary school educational activities are as follows:

Suspension of Educational Activities for Secondary Schools

  1. A secondary school shall be suspended from educational activities if it falls into one of the following cases:

a) Committing fraud to be authorized to conduct educational activities;

b) Unauthorized educational activities;

c) Not starting educational activities within one year from the date of authorization to conduct educational activities;

d) Violating legal provisions on education, subject to administrative penalties at a level requiring a suspension of educational activities;

dd) Other cases of violations as prescribed by law.

From the above regulations, a specialized school for arts, sports, and physical education will be suspended from educational activities if it does not start educational activities within one year from the date of authorization.
