Pursuant to Article 3 of Decree 125/2024/ND-CP, the conditions for allowing the establishment of a preschool from November 20, 2024, are as follows:
- There must be a scheme for establishment or approval to establish a preschool aligned with the provincial planning and related local planning where the school headquarters are located.
- The scheme must clearly define the objectives, tasks, curriculum, and preschool education content; land, facilities, equipment, planned school construction location; organizational structure; resources and finances; and strategic direction for building and developing the preschool.

Pursuant to Article 5 of Decree 125/2024/ND-CP, the conditions for a preschool to operate educational activities from November 20, 2024, include:
- Having land, facilities, equipment, supplies, and toys meeting the standards regarding location, scale, area, and minimum facilities for preschools as stipulated by the Ministry of Education and Training.
In the inner city areas of special-type urban zones, the land area for school construction may be replaced by building floor area, and the building floor area must not be less than the minimum average land area per child as regulated.
- Having educational programs, materials, and resources that meet the requirements of preschool education programs as stipulated by the Ministry of Education and Training.
- Having a team of management staff, teachers, employees, and workers ensuring sufficient quantity and meeting standards to organize nurturing, caring for, and educating children to meet the requirements of preschool education programs as per the Ministry of Education and Training regulations.
- Possessing sufficient financial resources to ensure the maintenance and development of educational activities:
+ For private preschools, the minimum investment is 30 million VND per child (not including land use costs). The total minimum investment is calculated based on the time of the highest projected scale. The investment capital plan must be consistent with the projected scale for each phase.
For private preschools that do not build new facilities but rather lease or use available facilities to carry out nurturing, care, and education for children, the minimum investment must reach 70% of the investment level specified in point a of this clause.
+ For public and community preschools, financial resources are ensured by the competent managing agency or the local community to meet the requirements of preschool education programs as stipulated.
- Having a regulation for the organization and operation of the school.
Who is authorized to decide on the establishment of a public preschool in Vietnam?
Pursuant to Article 4 of Decree 125/2024/ND-CP regarding procedures for establishing public preschools or permitting the establishment of private preschools:
Procedure for Establishing Public or Permitting the Establishment of Private Preschools
- The Chairperson of the District People's Committee, district, city, district-level town in the province (commonly referred to as the District-level People’s Committee) decides on the establishment of public preschools or permits the establishment of private preschools.
- The dossier includes:
a) Application for establishment or permission to establish a preschool (as per Form No. 01, Appendix I attached to this Decree);
b) Scheme for establishment or permission to establish a preschool (as per Form No. 02, Appendix I attached to this Decree).
- Procedure steps:
a) The Commune-level People’s Committee (in case of proposing to establish a public preschool); organizations or individuals (in case of proposing permission to establish a private preschool) submit one dossier set as specified in clause 2 of this Article through the online public service portal or by post or directly to the District-level People’s Committee;
