Is October 20 a day off for teachers in Vietnam?

Pursuant to the provisions of Article 112 Labor Code 2019 regarding holidays:

Holidays

1. Employees are entitled to leave from work and full pay on the following holidays:

a) New Year's Day: 01 day (January 1);

b) Lunar New Year: 05 days;

c) Victory Day: 01 day (April 30);

d) International Labor Day: 01 day (May 1);

dd) National Day: 02 days (September 2 and 01 day immediately before or after);

e) Hung Kings' Festival: 01 day (March 10, lunar calendar).

2. Foreign workers in Vietnam, in addition to the holidays specified in paragraph 1, are entitled to take 01 additional traditional New Year day and 01 day of their country's National Day.

3. Annually, based on practical conditions, the Prime Minister of Vietnam shall decide specific days off as prescribed at points b and đ, paragraph 1 of this Article.

Pursuant to the provisions of Article 115 Labor Code 2019 regarding personal leave and unpaid leave:

Personal leave, unpaid leave

1. Employees are entitled to personal leave with full pay and must notify the employer in the following cases:

a) Marriage: 3 days' leave;

b) Child marriage: 1 day leave;

c) Biological father, biological mother, adoptive father, adoptive mother; biological father, biological mother, adoptive father, adoptive mother of the spouse; spouse; biological child, adopted child passing away: 3 days' leave.

2. Employees are entitled to 1 day off without pay and must notify the employer when grandparents, siblings pass away; parental marriage; siblings’ marriage.

3. Besides the provisions in paragraphs 1 and 2 of this Article, employees may negotiate with their employers to take unpaid leave.

Thus, October 20 is not one of the public holidays or personal leave days that teachers are entitled to leave.

What are the criteria for determining regional allowance for teachers in Vietnam?

Pursuant to Subsection 1, Section II of Joint Circular 11/2005/TTLT-BNV-BLDTBXH-BTC-UBDT, the criteria for determining regional allowance for teachers are:

- Natural geographical factors such as: harsh climate, extreme temperature, humidity, altitude, air pressure, wind speed, etc., deviating from normal levels affecting human health;

- Remoteness, sparsity (low population density, far from cultural, political, economic centers, away from mainland…), poor infrastructure like roads, bridges, schools, healthcare facilities, commercial services, creating difficulties in living conditions:

Additionally, when determining regional allowances, special difficulty factors, border, island, swamp can be considered.

- Regional allowance is mainly determined according to the administrative geography of communes, wards, and commune-level towns (collectively referred to as communes). State agencies, units, companies located in any commune will receive the level of regional allowance applicable to that commune. Some special cases located far or bordering multiple communes are considered for special regional allowance.

- When factors for determining regional allowance or the geographical basis of a commune change (division, merger, new establishment…), the regional allowance is reviewed or adjusted accordingly.
