Are students in Vietnam entitled to a day off on the Gregorian New Year?

Under the provisions of Article 112 of the Labor Code 2019 on public holidays:

Public holidays

1. Employees shall be entitled to fully paid days off on the following public holidays:

a) Gregorian Calendar New Year Holiday: 01 day (the 1st of January of the Gregorian calendar);

b) Lunar New Year Holidays: 05 days;

c) Victory Day: 01 day (the 30th of April of the Gregorian calendar);

d) International Labor Day: 01 day (the 1st of May of the Gregorian calendar);

dd) National Day: 02 days (the 2nd of September of the Gregorian calendar and the previous or next day);

e) Hung Kings Commemoration Day: 01 day (the 10th of the third month of the Lunar calendar).

2. Foreign employees in Vietnam are entitled to 01 traditional public holiday and 01 National Day of their country, in addition to the public holidays stipulated in Clause 1 of this Article.

3. The Prime Minister shall decide the specific public holidays mentioned in Point b and Point dd Clause 1 of this Article on an annual basis.

Simultaneously, according to Article 1 of Decision 2045/QD-BGDDT 2024, the regulations are as follows:

Issuing the framework for the 2024-2025 academic year plan for preschool, general education, and continuing education nationwide as follows:

1. The earliest school opening date is set 1 week before the official commencement ceremony. For first graders, the earliest start date is 2 weeks prior to the commencement ceremony.

2. The commencement ceremony is organized on September 05, 2024.

3. The first semester ends before January 18, 2025, and the school year is completed before May 31, 2025.

4. The recognition of completion of primary education and graduation from lower secondary education is conducted before June 30, 2025.

5. Enrollment for the first classes of all educational levels is completed before July 31, 2025.

6. The national high school exam 2025 is scheduled to take place on June 26 and June 27, 2025.

7. Other national-level exams are organized as per the Ministry of Education and Training’s guidelines and regulations.

Thus, students will have days off on the following holidays:

- Gregorian Calendar New Year Holiday: 01 day (the 1st of January of the Gregorian calendar);

- Lunar New Year Holidays: 05 days;

- Victory Day: 01 day (the 30th of April of the Gregorian calendar);

- International Labor Day: 01 day (the 1st of May of the Gregorian calendar);

- National Day: 02 days (the 2nd of September of the Gregorian calendar and the previous or next day);

- Hung Kings Commemoration Day: 01 day (the 10th of the third month of the Lunar calendar).

Therefore, in accordance with the regulations, students in Vietnam are entitled to 01 day off on the Gregorian New Year according to the teachers' schedule.

What are the three phases in the education plan for the 2024-2025 academic year?

Under Section 4 of the General Education Program promulgated with Circular 32/2018/TT-BGDDT, the education plan for the 2024-2025 academic year for students at all levels is as follows:

The general education program is divided into two stages:

The basic education stage (from grades 1 to 9) and the Career-Oriented Education Phase (from grades 10 to 12).

The educational system includes compulsory subjects and activities, optional subjects according to vocational orientation (referred to as elective subjects), and optional subjects.

The actual learning time per school year is approximately 35 weeks. Educational institutions can organize either half-day or full-day classes.

Both types of educational settings must comply with the universal compulsory education content consistently across the nation.

[1]. Basic Education Stage

- Primary education level

Implement full-day teaching, with no more than 7 lessons per day; each lesson lasting 35 minutes. Schools lacking conditions for full-day teaching follow the educational plan guidelines provided by the Ministry of Education and Training.

- Lower secondary education level

Conduct one session per day, with no more than 5 lessons in one session; each lesson lasting 45 minutes. Encouragement is given to lower secondary schools with adequate conditions to conduct full-day teaching following the Ministry of Education and Training guidelines.
