What is the current retirement age for teachers in Vietnam?

Under Clause 1 Article 46 of the Law on Public Employees 2010 regarding retirement benefits:

Under Article 169 of the Labor Code 2019, the retirement age is regulated as follows:

Retirement ages

1. An employee who has paid social insurance for an adequate period of time as prescribed by social insurance laws shall receive retirement pension when he/she reaches the retirement age.

2. Retirement ages of employees in normal working conditions shall be gradually increased to 62 for males by 2028 and 60 for females in 2035.

From 2021, the retirement ages of employees in normal working conditions shall be 60 yeas 03 months for males and 55 years 04 months for females, and shall increase by 03 months for males and 04 months for females after every year.

3. The retirement ages of employees who suffer from work capacity reduction; doing laborious, toxic or dangerous works; working in highly disadvantaged areas may be younger by up to 05 years than the retirement ages specified in Clause 2 of this Article, unless otherwise prescribed by law.

4. Retirement ages of skilled employees and employees in certain special cases may be older by up to 05 years than the retirement ages specified in Clause 2 of this Article, unless otherwise prescribed by law.

5. The Government shall elaborate this Article.

Thus, under normal working conditions, starting from 2021, the retirement age for male teachers is 60 years and 03 months and for female teachers is 55 years and 04 months; each year the retirement age for male teachers increases by 03 months and for female teachers by 04 months.

The retirement age for teachers in 2024 is:

- Male teachers: From 61 years old.

- Female teachers: From 56 years and 4 months old.

What are the required documents for pension enjoyment by teachers in Vietnam?

Under Clause 1 Article 108 of the Law on Social Insurance 2014 regarding the dossier for pension enjoyment:

1. A dossier for pension enjoyment for employees covered by compulsory social insurance must comprise:

a/ The social insurance book;

b/ The decision permitting an employee to stop working under the retirement benefits or the document terminating an employment contract with an employee for enjoying the retirement benefits;

c/ The written record of assessment of the working capacity decrease, made by the Medical Assessment Council, for employees who retire under Article 55 of this Law, or the certificate of HIV/AIDS infection due to occupational risks, for the employees defined in Article 54 of this Law.

Thus, the required documents for pension enjoyment by teachers in Vietnam include:

- Social insurance book.

What are the procedures for pension enjoyment by teachers in Vietnam?

Under Article 110 of the Law on Social Insurance 2014 regarding the settlement of pension or lump-sum social insurance allowance:

Settlement of pension or lump-sum social insurance allowance

1. Within 30 days by the time an employee enjoys pension, the employer shall submit a dossier specified in Clause 1, Article 108 of this Law to the social insurance agency.

2. Within 30 days by the time an employee enjoys pension, employees having their period of social insurance premium payment reserved or employees covered by voluntary social insurance shall submit a dossier specified in Clause 2, Article 108 of this Law to the social insurance agency.

3. Within 30 days by the time an employee becomes eligible and requests payment of lump-sum social insurance allowance, he/she shall submit a dossier specified in Article 109 of this Law to the social insurance agency.

4. Within 20 days after receiving a complete and valid dossier, for to-be- pensioners, or within 10 days after receiving a complete and valid dossier, for persons to enjoy a lump-sum social insurance allowance, the social insurance agency shall settle the enjoyment of pension or lump-sum allowance and make payment to employees; or issue a written reply clearly stating the reason for its refusal to settle such enjoyment.

Thus, the procedures for pension enjoyment by teachers in Vietnam are conducted as follows:

- Step 1: Within 30 days before the teacher starts receiving the pension, the employer must submit the documents to the social insurance agency.

- Step 2: Within 20 days from the date of receiving the full documents as prescribed for pension recipients, the social insurance agency is responsible for resolving and organizing the payment for the teacher; in case of refusal, it must reply in writing and clearly state the reason.
