Under Article 61 Education Law 2019 as follows:

 

Boarding and semi-boarding ethnic secondary schools, pre-university schools

1. The State shall establish boarding and semi-boarding general education schools and pre-university schools for ethnic minority children, and for children of long-term resident families in areas with exceptional socio-economic difficulties.

2. Boarding and semi-boarding ethnic secondary schools and pre-university schools shall be given priority in allocation of teachers, infrastructure, equipment and budget.

3. The Minister of Education and Training shall provide for conditions for students to study in boarding and semi-boarding ethnic secondary schools and pre-university schools.

Furthermore, Article 3 of the Regulation on the organization and operation of semi-boarding ethnic secondary schools issued together with Circular 03/2023/TT-BGDDT states as follows:

Semi-boarding ethnic secondary schools

1. semi-boarding ethnic secondary schools are established by the State for ethnic minority students, students from families with long-term settlements in areas with particularly difficult socio-economic conditions in order to contribute to achieving equality in access to education and the goal of sustainable development in the education sector in ethnic minority and mountainous areas.

What is the ratio of ethnic minority students and semi-boarding students required for each semi-boarding ethnic secondary school in Vietnam?

According to Clause 2 Article 3 of the Regulation on the organization and operation of semi-boarding ethnic secondary schools issued together with Circular 03/2023/TT-BGDDT, semi-boarding ethnic secondary schools ensure the stability of the ratio of ethnic minority students and semi-boarding students as follows:

- The ratio of ethnic minority students: At least 50% of the total number of students of the whole school are ethnic minority students.

- The ratio of semi-boarding students:

+ For semi-boarding primary schools for ethnic minorities: At least 20% of students are semi-boarding students;

+ For semi-boarding lower secondary schools for ethnic minorities: At least 45% of students are semi-boarding students;

+ For semi-boarding primary and lower secondary schools for ethnic minorities: At least 32.5% of students are semi-boarding students or at least 20% of primary students are semi-boarding students and 45% of lower secondary students are semi-boarding students.

- The system of semi-boarding ethnic secondary schools includes:

+ Semi-boarding primary schools for ethnic minorities;

+ Semi-boarding Lower secondary schools for ethnic minorities;

+ Semi-boarding primary and lower secondary schools for ethnic minorities.

What are the duties and powers of semi-boarding ethnic secondary schools?

According to Article 4 of the Regulation on the organization and operation of semi-boarding ethnic secondary schools issued together with Circular 03/2023/TT-BGDDT, the duties, and powers of semi-boarding ethnic secondary schools are as follows:

- Organize the admission of semi-boarding students as per the Government of Vietnam's regulations.

- Organize the management, education, nurturing, and care of semi-boarding students.

- Organize educational activities as prescribed in Clause 2 Article 11 of the Regulation on the organization and operation of semi-boarding ethnic secondary schools issued together with Circular 03/2023/TT-BGDDT.

- Implement policies for management staff, teachers, staff, and students as prescribed by the Government.

- Implement private investment to serve the educational activities of the school.

- Coordinate with families and society in managing, educating, nurturing, and caring for semi-boarding students.

semi-boarding ethnic secondary schools, in addition to the aforementioned duties and powers, also perform other duties and powers according to current regulations on general education institutions as follows:

Regulations for primary schools, lower secondary school, upper secondary school and multi-level school charter (hereinafter referred to as Regulations on general education institutions).

*Duties and powers of primary schools (Article 3 of the Regulations for Primary Schools issued together with Circular 28/2020/TT-BGDDT)

- Publicize objectives, programs, educational plans, quality assurance conditions, assessment and evaluation results, and education quality accreditation; organize teaching, learning, and educational activities to achieve the quality and objectives required by the primary education program issued by the Ministry of Education and Training.

- Implement compulsory education, universal education, and literacy eradication in the locality. Mobilize children to attend school at the right age, encourage and create conditions for children with special circumstances to attend school. Sponsor and manage the educational activities of other educational institutions implementing primary education programs as assigned by competent authorities.

- Develop and implement the school's strategic and development plans according to the regulations of the Ministry of Education and Training, linked to the local socio-economic conditions; develop educational activity plans to meet the objectives and requirements of the primary education program.

- Implement the primary education program issued by the Ministry of Education and Training; select textbooks as prescribed by the Ministry of Education and Training; implement textbooks and local educational content according to decisions of the People's Committees of provinces and centrally-governed cities (hereinafter referred to as provincial People's Committees); exercise professional autonomy in organizing educational activities in primary schools.

- Conduct self-assessment and quality assurance in education as defined.

- Manage staff, teachers, staff, and students.

- Manage and utilize land, finances, and assets of the school according to legal regulations.

- Closely coordinate with parents or guardians of students, organizations, and individuals in the community to carry out educational activities. Organize for teachers, staff, and students to participate in social activities in the locality.

- Build and participate in cultural and educational environments in the school, contribute to building cultural and educational environments in the locality.

- Receive donations, aid from agencies, organizations, and individuals for the school according to legal regulations.

- Implement other tasks and powers as per legal regulations.

*Duties and powers of secondary schools (Article 3 of the Regulations for lower secondary school, upper secondary school and multi-level school charter issued together with Circular 32/2020/TT-BGDDT)

- Formulate the school’s development plans and strategies as appropriate to the socio-economic situation of the location where the school is located; determine the school’s vision, mission, and core values in relation to education, culture, history and traditions.

- Develop and launch the school’s education plans in accordance with the general education curricula promulgated by the Minister of Education and Training. Cooperate with students’ families, organizations and individuals in organization of educational activities.

- Admit and receive students, and manage students according to regulations of the Ministry of Education and Training.

- Launch plans for universalization of education as assigned.

- Enable teachers, staff and students to participate in social activities.

- Manage teachers and staff as prescribed by law.

- Mobilize, manage and use resources for education in compliance with the law.

- Manage, use and preserve facilities and equipment as per the law.

- Carry out activities of educational quality assurance, assessment and accreditation according to regulations of the Ministry of Education and Training.

- Publicly announce the school’s commitment to educational quality, educational quality assurance conditions, and revenues and expenditures in compliance with the law.

- Practice democracy and accountability in management of educational activities; ensure the participation of students, students’ families and the society in management of educational activities as prescribed by law.

- Perform other duties and exercise other powers as prescribed by law.
