Under Clause 2 Article 11 of the Regulations on Undergraduate Education issued together with Circular 08/2021/TT-BGDDT, the following provisions apply:

2. Students will be forced to leave school in any of the following cases:
a) Number of academic warnings or level of academic warning received exceeds the permitted amount/ level according to regulations of the training institution;
b) Study duration exceeds the amount of time mentioned in Clause 5 Article 2 of this Regulation.
3. Training institution regulations shall provide for the following matters:
a) Application of some conditions for academic warning and permitted number of academic warnings or academic warning level, which shall allow for no more than 2 consecutive warnings;
b) Procedures for academic warning and forced leave from school; and announcement of such measures to students;
c) Retention of accumulated study results in case of forced leave from scho

2. Students will be forced to leave school in any of the following cases:
a) The academic year average grade is under 0,8;
b) GPA is under 1,2 after 2 years of study, under 1,4 after 3 years of study and under 1,6 after 4 or more years of study;
c) Study duration exceeds the amount of time mentioned in Clause 5 Article 2 of this Regulation.
3. Students besides those mentioned in Clauses 1 and 2 of this Article may attend the same class as the later cohort to improve their academic performance.

Thus, students trained by credits will only be expelled from school if the number of academic warnings or the level of academic warnings received exceeds the permitted amount/level according to the regulations of the training institution.
Currently, Vietnamese law does not specify the number of academic warnings resulting in forced expulsion for students. This matter will be determined by each university.

When are students subjected to forced expulsion in Vietnam?
According to Article 9 of the Regulations for Student Affairs for Full-time Undergraduate Programs issued together with Circular 10/2016/TT-BGDDT, forced expulsion is regulated as follows:
Forms of discipline and details of violation
1. Violating students may, depending on the nature, extent and consequence of their violation, receive warnings, reprimands or may be subject to one of the following disciplinary actions:

d) A disciplinary action represented in the form of forced forced expulsion shall be imposed on students who continue to breach rules during the fixed-term suspension period, or commit violations for the first time which have extremely serious nature or level and cause adverse effects on their higher education institutions and society; those who contravene laws and serve jail sentences.
2. A disciplinary action which is at least a warning must be recorded into student administration documentation and informed to student's families. Where students are subject to fixed-term suspension or forced expulsion, higher education institutions must inform local authorities and student's families for their coordination in supervision and education of these students.
3. Details of violation and disciplinary framework shall be prescribed in the Appendix hereto attached.
Thus, students are subjected to forced expulsion when:
- Students continue to breach rules during the fixed-term suspension period or;
- Students commit violations for the first time which have extremely serious nature or level and cause adverse effects on their higher education institutions and society;
- Students ontravene laws and serve jail sentences.
What are the procedures for taking disciplinảy actions against university students in Vietnam?
Under Article 10 of the Regulations on Student Affairs for Full-time Undergraduate Programs issued together with Circular 10/2016/TT-BGDDT, the procedures for disciplining university students are as follows:
Step 1: Violating students shall be forced to write self-criticism reports in which appropriate disciplinary actions imposed on them are clearly stated.
If these students fail to comply, the Student Reward and Discipline Board shall proceed to hold a meeting that discusses and agrees on disciplinary actions to be imposed on these students based on available evidence;
Step 2: Head teachers of classes attended by these students shall join meetings with all students in these classes, discuss and agree on recommended disciplinary measures on which departments or student affairs units will then make their decisions;
Step 3: Departments or student affairs units shall make their assessment before recommending the Student Reward and Discipline Board to make its decision on these recommended measures;
Step 4: The Board will then convene a meeting over disciplinary actions to be imposed which is attended by Board members, representatives of class attended by violating students and violating students themselves.
If violating students who have been invited to such meeting are absent (for no sound reasons) and do not submit their self-criticism reports, the Board shall hold the meeting as planned and charge them with lack of organizational self-discipline.
Step 5: The Board shall then vote on disciplinary actions to be applied and request Heads of higher education institutions to issue written decisions on approval of these actions..
