Firstly, preschool or preschool educational institutions are defined according to Article 26 of the Law on Education 2019. Preschools are a general term used to refer to preschool educational institutions, including:
- Junior kindergarten centers and classes for children aged 03 – 36 months;
- Senior kindergartens and independent senior kindergarten classes for children aged 03 – 06 years;
- Combined kindergartens and independent preschool classes for children aged 03 months – 06 years.
The structure and organization of independent junior kindergarten classes with over 07 children, independent senior kindergarten classes, and independent preschool classes include: the preschool owner; professional manager; teachers, staff (if any) and junior kindergarten classes, senior kindergarten classes. (Article 10 of the Organizational and Operational Regulation of independent junior kindergarten classes, independent senior kindergarten classes, independent preschool classes in the types of people-found and private, issued together with Circular 49/2021/TT-BGDDT)
Simultaneously, regarding the owner of a private preschool, the regulations are as follows:
Under Clause 1, Article 11 of the Organizational and Operational Regulation of independent junior kindergarten classes, independent senior kindergarten classes, and independent preschool classes in the types of people-found and private, issued together with Circular 49/2021/TT-BGDDT, the owner of the preschool is an individual or an individual representing an organization applying to establish an independent preschool educational institution.
Standards for the owner of a private preschool:
- Be a citizen of the Socialist Republic of Vietnam
- Have good character and ethics
- Be under the age of 65
- Have good health condition
- Have a high school diploma or higher.
Thus, the standard for the owner of a private preschool is to have a high school diploma or higher (i.e., have completed the 12th-grade education program).
Therefore, a person who has not yet completed the 6th-grade education program in Vietnam may not open a private preschool.

Under Clause 3, Article 11 of the Organizational and Operational Regulation of independent junior kindergarten classes, independent senior kindergarten classes, and independent preschool classes in the types of people-found and private, issued together with Circular 49/2021/TT-BGDDT, the tasks and rights of the owner of a preschool educational institution are as follows:
- Tasks
+ Direct and manage activities of nurturing, caring for, and educating children
+ Treat children, teachers, and staff fairly and respectfully
+ Direct and build a safe, healthy, friendly environment, prevent violence
+ Invest in and manage facilities, equipment, supplies, toys, learning tools, and materials serving the nurturing, caring for, and educating activities of children as per regulations
+ Ensure policies for teachers and staff according to regulations
+ Implement publicity as prescribed.

+ Enter into labor contracts with teachers and staff according to regulations
+ Hold concurrently the professional management, teaching, and staff positions if meeting the conditions and standards as prescribed
+ Negotiate tuition fees with parents or legal guardians of children
+ Participate in training classes on politics, professional skills, and management
+ Enjoy policies as per regulations.
Based on the regulations regarding tuition fees, it is clear that once becoming the owner of a private preschool, one has the right to negotiate tuition fees with parents or legal guardians of children.
Thus, the owner of a preschool educational institution can flexibly adjust the tuition fees with the parents or legal guardians of the children attending the school.
What are the responsibilities of families and society regarding the organization and operation of private preschools in Vietnam?
Under Article 25 of the Organizational and Operational Regulation of independent junior kindergarten classes, independent senior kindergarten classes, and independent preschool classes in the types of people-found and private, issued together with Circular 49/2021/TT-BGDDT, the responsibilities of families and society regarding the organization and operation of private preschools include:
- Each family shall contact and exchange with the independent preschool education institution to keep informed on the child to cooperate in the child’s care and education at home; and actively join activities of the independent preschool education institution.
- Voluntarily contribute wisdom, effort, funding, and materials to improve the facilities and strengthen activities of independent preschool education institutions, exercising the oversight right to make effective use of resources.
- Participate in and enable children to participate in community activities with suitable contents and forms to improve the quality of children’s care and education.
