According to Clause 1, Article 66 of the Education Law 2019 of Vietnam, teachers are individuals who teach at preschool education institutions, general education institutions, primary schools, secondary schools, and universities.
Thus, public junior high schools under the Ministry of Education and Training are public service providers.
This means that Level 2 junior high school teachers working under employment policies at public service providers are public employees.
Additionally, as stipulated in Article 1 of Circular 03/2021/TT-BGDDT of the Ministry of Education and Training of Vietnam, there are provisions regarding the scope of regulation and subjects of application as follows:
Scope of Regulation and Subjects of Application
1. This Circular prescribes the codes, standards of professional titles, and the appointment and salary classification of public employees teaching at public junior high schools.
2. This Circular applies to public employees teaching junior high school programs, including teachers, principals, vice principals, directors, deputy directors (hereinafter referred to as junior high school teachers) in junior high schools, general education schools with many levels of education including junior high schools, continuous education centers, vocational education - continuous education centers, public specialized schools (hereinafter referred to as public junior high schools) and other related organizations and individuals.
3. Private junior high schools may apply the provisions of this Circular for the recruitment, utilization, and management of teachers.
Thus, public employees are those who teach at the following public junior high schools:
- Teachers, principals, vice principals, directors, deputy directors (hereinafter referred to as junior high school teachers) in public junior high schools:
+ Junior high schools;
+ General education schools with many levels of education including junior high schools;
+ Continuous education centers, vocational education - continuous education centers
+ Public specialized schools.
- Other related individuals.
Therefore, according to the regulations, Level 2 junior high school teachers teaching at public junior high schools are public employees.

What are the duties of level-2 lower secondary school teachers at public lower secondary schools?
According to Clause 1, Article 4 of Circular 03/2021/TT-BGDDT, the duties of Level 2 junior high school teachers are specified as follows:
Level II Junior High School Teacher - Code V.07.04.31
1. Duties
In addition to the duties of a Level III junior high school teacher, a Level II junior high school teacher must also perform the following duties:
a) Act as a reporter or demonstrate teaching in teacher training courses or pilot teaching new models, methods, technologies from school level onwards; preside over training content and specialized topics in special committees or participate in building electronic teaching materials;
b) Participate in guiding or evaluating scientific and technological research products from school level onwards;
c) Participate in social activities, community service; attract the participation of organizations and individuals in organizing teaching and educational activities for students;
d) Participate in external evaluation teams; or perform professional inspection tasks and operations for teachers from school level onwards;
đ) Participate in judging panels, or act as examiners or mentors in competitions (for teachers or students) from school level onwards (if any).
Level 2 junior high school teachers will have five (5) duties in public junior high schools as follows:
(1) Act as a reporter or demonstrate teaching in teacher training courses or pilot teaching new models, methods, technologies from school level onwards; preside over training content and specialized topics in special committees or participate in building electronic teaching materials;
(2) Participate in guiding or evaluating scientific and technological research products from school level onwards;
(3) Participate in social activities, community service; attract the participation of organizations and individuals in organizing teaching and educational activities for students;
(4) Participate in external evaluation teams; or perform professional inspection tasks and operations for teachers from school level onwards;
(5) Participate in judging panels, or act as examiners or mentors in competitions (for teachers or students) from school level onwards (if any).
Additionally, Level 2 junior high school teachers must also fulfill the duties of Level 3 junior high school teachers.
How is the salary of level-2 lower secondary school teachers who are appointed to the professional title determined?
According to Article 8 of Circular 03/2021/TT-BGDDT, the salary classification method is stipulated as follows:
- Public employees appointed to the professional titles of junior high school teachers specified in Circular 03/2021/TT-BGDDT are applied the salary scales corresponding to public employees as issued with Decree 204/2004/ND-CP specifically as follows:
+ Level 3 junior high school teachers, code V.07.04.32, are applied the salary coefficient of public employees type A1, from salary coefficient 2.34 to salary coefficient 4.98;
+ Level 2 junior high school teachers, code V.07.04.31, are applied the salary coefficient of public employees type A2, group A2.2, salary coefficient 4.00 to salary coefficient 6.38;
+ Level 1 junior high school teachers, code V.07.04.30, are applied the salary coefficient of public employees type A2, group A2.1, from salary coefficient 4.4 to salary coefficient 6.78.
Thus, when appointed to the professional title of Level 2 junior high school teachers, they will be classified in terms of salary from the salary coefficient of 4.00 to 6.38.
According to Article 3 of Circular 07/2024/TT-BNV, the salary of public employee teachers is calculated as follows:
