What is the procedure for transferring schools for primary school students coming from abroad to Vietnam?
The procedures for school transfer for primary students returning from abroad are stipulated in Clause 3, Article 36 of the Primary School Charter issued together with Circular 28/2020/TT-BGDDT:
Step 1: Parents or guardians of the student submit the application to the school where the transfer is intended, either in person, by mail, or online via the Public Service Portal (if available).
Step 2: Within no more than 03 working days from the date of receipt of the application, the principal of the receiving school must give consent by endorsing the application. If not agreeable, the reasons must be clearly stated on the application and returned to the parents or guardians in the manner the application was received.
Step 3: If the student is accepted, within no more than 07 working days from the date of receipt of the application, the principal of the primary school will organize an assessment of the student's academic level, place the student in the appropriate class, and manage the student's records according to regulations.
What are the rights of primary school students transferring schools?
The rights of primary students transferring schools are the same as the rights of primary students in general. According to Article 35 of the Primary School Charter issued together with Circular 28/2020/TT-BGDDT, the specific rights of primary students include:
(1) The right to education
- To receive education and training for comprehensive development and to best realize their own potential; to study in a school or class implementing the primary education program convenient to their place of residence.
- Students may choose their school or transfer to another school outside of their residential area if the school can accommodate them.
- Primary-aged children returning from abroad, children of foreigners studying or working in Vietnam, and children in difficult circumstances who have not attended school may, upon request, be assessed by the principal to be placed in an appropriate class.
- Students with disabilities may attend an inclusive primary school; they are ensured the conditions for study and practice, and are educated and assessed according to their individual educational plans.
- Students may accelerate or extend the time to complete the program, study at an older age than prescribed, or repeat a grade.
- Students with good physical strength and early intellectual development may be allowed to skip grades within the primary level.
The procedure for each specific case is carried out as follows:
Parents or guardians of the student submit a request to the school.
The principal forms an advisory council, including the principal or vice-principal and the school's Parent Representative Committee; the class teacher, the teacher of the higher-level class, the healthcare worker, and the team leader.
Based on the council's assessment, the principal completes the dossier and reports to the head of the Department of Education and Training for consideration and decision.
- Students with limited academic performance who have been directly guided and helped by teachers, parents, or guardians and still have not completed the required academic tasks may, depending on the extent of incomplete tasks, have their class advancement or repetition considered by the teacher and decided by the principal in consultation with the family for appropriate educational measures.
(2) The right to protection, care, respect, and equal and democratic treatment; assurance of legitimate rights and interests; provision of complete information on their study and self-improvement process; assurance of time, facilities, hygiene, and safety conditions for studying and practicing.
(3) The right to participate in activities that develop personal capabilities; the right to express personal opinions and aspirations.
(4) The right to receive scholarships and benefit from social policies in accordance with regulations.
(5) Other rights as prescribed by law.
How is the age of primary school students regulated?
According to Article 33 of the Primary School Charter issued together with Circular 28/2020/TT-BGDDT regarding the age of primary students:
- The age for entering Grade 1 is 06 years, calculated by year.
Children with disabilities, those with physical or intellectual delays, children in areas with particularly difficult socio-economic conditions, ethnic minority children, orphans, children returning from abroad, and children of foreigners studying or working in Vietnam may start Grade 1 at an older age than prescribed but not exceeding 03 years.
In cases where children start Grade 1 at an age exceeding the 03-year limit, the decision will be made by the head of the Department of Education and Training.
- Primary students may study at an older age than prescribed if they repeat a grade, live in areas with particularly difficult socio-economic conditions, belong to ethnic minorities, have disabilities, have physical or intellectual delays, are orphans, return from abroad, or fall under other lawful circumstances.
