Under Article 13 of the Public Employee Law 2010:

Rights of public employees to rest

1. To take annual leaves, holidays and leaves for personal reasons under the labor law. Public employees who do not use any or all of prescribed annual leave days due to work requirements are entitled to a sum of money for those days on which they work.

2. Public employees working in mountainous, border, island, deep-lying and remote areas and in other special cases may take leave days of 2 years at a time if they so wish. If wishing to take leave days of 3 years at a time, they shall obtain consent of the heads of their public service providers.

3. For special non-business fields, public employees may take paid leaves as provided by law.

4. To lake unpaid leaves for plausible reasons and after obtaining consent of the heads of their public service providers.

Thus, teachers who are public employees are entitled to annual leave, leave on public holidays, and personal leave as per labor laws.

Currently, only female employees may leave early under certain conditions as stipulated in Article 137 of the Labor Code 2019 regarding maternity protection.

Meanwhile, Article 80 of Decree 145/2020/ND-CP stipulates that female employees in their menstruation period can take a break as follows:

- During the menstruation period, female employees are entitled to a daily break of 30 minutes which will be included in their working time and fully paid under their employment contracts.

-  The number of days of menstrual leave shall be negotiated by both parties according to the working conditions and the needs of the female employees

Therefore, female employees in their menstruation period may leave up to 30 minutes early per menstruation day.

Thus, Vietnamese law does not currently provide for the right to leave early on November 20 for teachers. Therefore, teachers are not permitted to leave early.

What are the guidelines of the Ministry of Education and Training for the celebration of Vietnam Teachers' Day on November 20?

Under Circular 26-TT-1982 issued by the Ministry of Education and Training, the guidelines for the celebration of Vietnam Teachers' Day on November 20 are detailed as follows:

- Vietnam Teachers' Day is uniformly celebrated nationwide on November 20 annually in all educational institutions at different levels, across kindergarten, supplementary education, general education, and teacher training sectors.

- Annually, from October, educational management levels and the Education Trade Union should proactively report to government and union authorities to hold meetings to review the work and activities of the teaching staff; evaluate achievements and set tasks to be continued.

- Important matters to be noted include:

+ State policies for teachers, such as providing food, distributing clothing, health care, living and working conditions, rest policies, salary policies, and concerns about education, political, and ethical training for CPV development… must be fully and promptly implemented to gradually improve the material and spiritual lives of teachers, contributing to building a stronger teaching staff.

+ Based on a comprehensive evaluation of the current teaching staff, teachers are required to enhance their awareness of their honor and responsibility, striving to perform their duties excellently, contributing to training new people to build socialism and protect the socialist homeland.

- Before or on November 20, educational management personnel should plan for leadership from party committees, government, educational council, parent associations, enterprises, organizations, women's and youth unions to visit, organize friendly meetings, and motivate and commend teachers, employees, and educational staff with achievements (including retired staff and teachers).

- Extensively promote the significance of Vietnam Teachers' Day in all sectors and classes at various levels.

- Use information channels, and meetings to propagate and commend practical deeds embodying the deep understanding of the significance of Vietnam Teachers' Day across all sectors and classes in our society.

- On November 20, schools can rearrange teaching and learning schedules to allow teachers to rest and participate in school and local activities.

- Each school should organize varied, concise activities.

- Schools should summarize competitions and launch new competition phases to effectively implement tasks set out in the first semester.

- Council of Ministers' decisions must be followed to ensure the significance of Vietnam Teachers' Day, localities should implement and apply good experiences to organize November 20 annually with grandeur and practicality, avoiding formalism and hassle for students and parents.
