According to Official Dispatch 8726/VPCP-KGVX regarding the Lunar New Year holiday and several public holidays:
Based on the proposal from the Ministry of Labor, Invalids and Social Affairs in documents No. 5152/BLDTBXH-CATLD dated October 22, 2024, and No. 5621/BLDTBXH-CATLD dated November 8, 2024, regarding the plan for Lunar New Year, National Day, and other public holidays in 2025, the Prime Minister of Vietnam, Pham Minh Chinh, has the following opinion:
Agrees with the proposal from the Ministry of Labor, Invalids and Social Affairs as mentioned in the documents for Lunar New Year, National Day, and the swap of working days during the holiday of Victory Day on April 30 and International Labor Day on May 1, 2025. The Minister of Labor, Invalids and Social Affairs will inform administrative agencies, public service providers, political organizations, socio-political organizations, enterprises, and employees according to regulations.

Thus, It will swap the normal working day on Monday, April 29 during the holiday of Victory Day on April 30 and International Labor Day on May 1, 2025 and arrange another working day.
Specifically, for officials and public employees, this working day will be arranged on Saturday, May 4, 2025. With this swap, officials and public employees will have a continuous 5-day holiday from Saturday, April 27 to Wednesday, May 1.
For employees, employers are encouraged to apply the same Victory Day - International Labor Day holiday as officials and public employees. Labor management agencies require compliance with all policies for employees in accordance with the law, encouraging more favorable agreements for employees.

According to Article 13 of the Law on Public Employees 2010, the regulation is as follows:
Rights of public employees to rest
1. To take annual leaves, holidays and leaves for personal reasons under the labor law. Public employees who do not use any or all of prescribed annual leave days due to work requirements are entitled to a sum of money for those days on which they work.

According to Article 111 of the Labor Code 2019 on weekly breaks:
Weekly breaks
1. Each week an employee is entitled to a break of at least 24 consecutive hours. Where it is impossible for the employee to have a weekly day off due to the work cycle, the employer has the responsibility to ensure that on average the employee has at least 04 days off per month.
2. The employer has the right to determine and schedule the weekly breaks either on Sunday or for another fixed day in a week, which must be recorded in the internal labor regulations.
3. In case a public holiday falls on an employee’s weekly break as prescribed in Clause 1 Article 112 of this Labor Code, he/she will have compensatory time-off on the next working days.
In 2025, since April 30 falls on a Tuesday and the May 1 holiday on a Wednesday (normally a working day), public employees (teachers) will find Monday to be a regular working day.
According to the regulation, the public holiday schedule for public employees will follow the Labor Code 2019.
In cases where the state facilitates officials, public employees, and employees to have the Victory Day - International Labor Day holiday that lasts 05 continuous days, public employees will swap their working day (Monday, April 29) to another day.
Swapping the working day (Monday, April 29) to a makeup day does not alter the work schedule, ensuring officials, public employees, and employees, have harmonious and complete holiday periods (ensuring at least 24 consecutive hours off).
If public employees are scheduled to swap their working day for a continuous five-day holiday, lower secondary school students will follow the same holiday schedule as public employees (teachers).

Under Clause 3, Article 5 of the regulations attached to Circular 28/2009/TT-BGDDT amended by Clause 4, Article 1 of Circular 15/2017/TT-BGDDT:
Annual wworking and leave period
The annual leave period for teachers includes: summer vacation, Lunar New Year holiday, semester breaks, and other holidays:
a) The annual summer vacation for teachers is 02 months (including both annual leave as prescribed by the Labor Code), with full pay and allowances (if any).
b) Lunar New Year holiday and semester breaks shall comeply with the regulations of the Minister of Education and Training;
c) Other holidays shall comeply with the Labor Code.
Based on the academic year's plan, scale, characteristics, specific conditions of each school, the principal arranges annual leave for teachers in a reasonably conformable manner.
Thus, the annual leave period for teachers includes summer vacation, the Lunar New Year holiday, semester breaks, and other holidays. Among them, other holidays are as prescribed by the Labor Code 2019.
Currently, there is no specific regulation regarding the holiday schedule for lower secondary school students. Therefore, lower secondary school students will follow the holiday schedule of their teachers and school.
Under Article 112 of the Labor Code 2019:
Public holidays
1. Employees shall be entitled to fully paid days off on the following public holidays:
a) Gregorian Calendar New Year Holiday: 01 day (the 1st of January of the Gregorian calendar);
b) Lunar New Year Holidays: 05 days;
c) Victory Day: 01 day (the 30th of April of the Gregorian calendar);
d) International Labor Day: 01 day (the 1st of May of the Gregorian calendar);
dd) National Day: 02 days (the 2nd of September of the Gregorian calendar and the previous or next day);
e) Hung Kings Commemoration Day: 01 day (the 10th of the third month of the Lunar calendar).
2. Foreign employees in Vietnam are entitled to 01 traditional public holiday and 01 National Day of their country, in addition to the public holidays stipulated in Clause 1 of this Article.
3. The Prime Minister shall decide the specific public holidays mentioned in Point b and Point dd Clause 1 of this Article on an annual basis.
Lower secondary school students across the country will have the following public holidays:
- Gregorian Calendar New Year Holiday: 01 day (the 1st of January of the Gregorian calendar);
- Lunar New Year Holidays: 05 days;
- Victory Day: 01 day (the 30th of April of the Gregorian calendar);
- International Labor Day: 01 day (the 1st of May of the Gregorian calendar);
- National Day: 02 days (the 2nd of September of the Gregorian calendar and the previous or next day);
- Hung Kings Commemoration Day: 01 day (the 10th of the third month of the Lunar calendar).
Note: Based on actual conditions, the Prime Minister of Vietnam will specifically decide the holidays for Lunar New Year and National Day.
