- Have moral virtue, have at least 5-year experience in teaching or management of vocational education;

- Have at least a Bachelor’s degree regarding the Principal of the vocational training school; have at least a Master’s degree regarding the Principal of the college;

- Have completed refresher courses in vocational education management;

- Attain fitness; ensure the age to participate in at least one tenure of the Principal regarding the appointment of the Principal of the public vocational training schools or colleges.

Under Clause 6, Article 11 of Circular 15/2021/TT-BLDTBXH, the principles for electing the Chairperson of the school council of a college in Vietnam are as follows:

6. The chairperson of the council is not the principal and is elected from amongst council members according to the majority principle, with a secret ballot, and must have more than 50% approval from the total council members. The chairperson of the council has the following duties and powers:

a) Issue the council's operational regulations after approval by the supervisory authority. Key contents of the council's operational regulations include: working regime, workflow handling process of the council; duties, responsibilities of council members; relationships between the council, the principal, and the Communist Party secretary of the institution; relationships between the council and the supervisory authority, state management agencies on vocational education at localities, and other bodies or units; reporting policies of the council;

b) Convene council meetings;

c) Decide on the meeting agenda, chair meetings and organize the voting in council meetings;

d) Direct the council to perform duties and powers as prescribed in Clause 2, Article 11 of the Law on Vocational Education and regulations in Clause 2 of this Article.

What are the duties of the Chairperson of the school council of a college in Vietnam before the end of the term?

According to Clause 2, Article 12 of Circular 15/2021/TT-BLDTBXH, three months before the end of the term, the Chairperson of the school council of a college in Vietnam shall:

- Organize meetings to determine the number and structure of council members;

- Request organizations as stipulated in Point a, Clause 3, Article 11 of the Law on Vocational Education 2014 to organize their meetings to elect representatives to participate in the council;

- Carry out the following tasks to propose establishing the council for the next term:

+ Propose the supervisory authority of the school or related production, business, and service units to appoint representatives to the council;

+ Elect the chairperson and secretary of the council: The election of the chairperson and the secretary of the council is conducted by secret ballot.

Note: In case there is a change in the chairperson, secretary, or council members during the term, the incumbent council will organize a meeting to decide on replacing the chairperson, secretary, and council members. When there is a change in the number of council members, the incumbent council proposes the school's supervisory authority to supplement and complete the council structure and composition as prescribed.

What are the cases of the relief from duty or dismissal of the school council's Chairperson who is an official in Vietnam?

(1) Cases of the relief from duty:

According to Point a, Clause 2, Article 13 of Circular 15/2021/TT-BLDTBXH, the official Chairperson of the school council is relieved from duty in one of the following cases:

- Have a written request from the individual to resign from the council;

- Be limited in civil act capacity;

- Have health that does not allow fulfilling assigned work, necessitating a work cessation for treatment exceeding 6 months without recovery of labor capacity;

- Have petitions from over 50% of the total council members in writing for relief from duty;

- Commit violations to the extent of dismissal as stipulated in the organizational regulations and operations of the school;

(2) Cases of dismissal:

According to Point b, Clause 2, Article 13 of Circular 15/2021/TT-BLDTBXH, the official Chairperson of the school council is is dismissed in one of the following cases:

- Use illegal documents for appointment;

- Fail to complete management and administration duties as assigned without justifiable reasons leading to serious consequences;

- Face imprisonment, suspended sentence or community sentences

- Commit significant violations of laws on anti-corruption, thrift practices, gender equality, social evils prevention and control;

- Commit violations to the extent of discharge as stipulated in the organizational regulations and operations of the school;
