Can primary school students in Vietnam extend their study time?

According to Article 35 of the Charter of Primary Schools issued with Circular 28/2020/TT-BGDDT, primary school students have the following rights:

Rights of Students

1. Right to education

a) Students are educated and learn to develop fully and to best promote their potential; to study in a school, class implementing the primary education program convenient for commuting within their residential area.

a) Students are allowed to choose their school or transfer to another school outside their residence area if the school is able to accept them.

c) Primary-aged students returning from abroad, children of foreigners studying and working in Vietnam, children facing difficulties not yet attending school, if desired, can be placed into a suitable class after a proficiency survey organized by the principal.

d) Disabled students are integrated into a primary school; to be ensured adequate conditions for study and practice; to be taught and evaluated according to the student's individual education plan.

dd) Students are allowed to shorten the educational program, study at an age older than the prescribed age, extend the study period, or repeat a class.

e) Students with exceptional physical and intellectual development may skip grades within the school level. The procedure is executed as follows:

The student’s parents or guardians must submit a request to the school.

The school principal forms an assessment and advisory board, including the principal or vice-principal and the Parent Committee; the student’s current teacher, above-current grade teacher, health staff, and team leader.

Based on the assessment results, the principal compiles a report for consideration and decision by the head of the Department of Education and Training.

Thus, under the above regulation, primary school students may extend their study period or repeat a class.

What is the regulatory age of primary school students in Vietnam?

According to Article 33 of the Charter of Primary Schools issued with Circular 28/2020/TT-BGDDT, the regulatory age of primary school students in Vietnam is as follows:

Age of primary school students

1. The age for entering first grade is 6. Disabled children, children with physical or intellectual impairments, children in particularly disadvantaged areas, ethnic minority children, orphans without support, children returning from abroad, and children of foreigners studying and working in Vietnam can enroll in grade one at an older age than prescribed but not exceeding 3 years. Cases where children exceed 3 years for grade one enrollment will be decided by the head of the Education and Training Department.

2. Primary students studying beyond the prescribed age are allowed in cases of repetition, those in particularly disadvantaged areas, students from ethnic minorities, students with disabilities, students with physical or intellectual impairments, orphans without support, students returning from abroad, and other cases as stipulated by law.

Thus, according to the above regulation, the age for entering first grade is 6 and the age for entering 5th grade is 10.

*Note: This regulation does not apply to cases entering at a higher age than prescribed or cases of early intellectual development.
