In Vietnam, what is the retirement age for teachers in 2025?
Retirement ages
1. An employee who has paid social insurance for an adequate period of time as prescribed by social insurance laws shall receive retirement pension when he/she reaches the retirement age.
2. Retirement ages of employees in normal working conditions shall be gradually increased to 62 for males by 2028 and 60 for females in 2035.
From 2021, the retirement ages of employees in normal working conditions shall be 60 yeas 03 months for males and 55 years 04 months for females, and shall increase by 03 months for males and 04 months for females after every year.
3. The retirement ages of employees who suffer from work capacity reduction; doing laborious, toxic or dangerous works; working in highly disadvantaged areas may be younger by up to 05 years than the retirement ages specified in Clause 2 of this Article, unless otherwise prescribed by law.
4. Retirement ages of skilled employees and employees in certain special cases may be older by up to 05 years than the retirement ages specified in Clause 2 of this Article, unless otherwise prescribed by law.
5. The Government shall elaborate this Article.
From 2021, the retirement ages of employees in normal working conditions shall be 60 yeas 03 months for males and 55 years 04 months for females, and shall increase by 03 months for males and 04 months for females after every year.
Thus, as of 2025, the retirement age for male teachers is 61 years and 3 months and for female teachers, it will be 56 years and 8 months.
Note: The retirement ages in 2025 apply to employees in normal working conditions.

What are the regulations on the retirement date for teachers of public schools in Vietnam?
Under Clause 1 Article 46 of the Law on Public Employees 2010, regulations on pensions are as follows:

1. Public employees are entitled to pensions as stipulated by the labor code and social insurance law.

Under Article 3 of Decree 135/2020/ND-CP, the regulation on retirement date and start date for retirement benefits is as follows:
Retirement date and start date for retirement benefits
1. Retirement date is the last day of the month in which one reaches the full retirement age as prescribed.
If an employee continues in employment after his full retirement age as prescribed, the retirement date is the date of termination of employment.
2. The start date for retirement benefits is the first day of the month following the month of the retirement date.
3. If the employee's dossier does not indicate his day and month of birth, but year of birth only, January 1 of his year of birth shall be used as the basis for determining of the retirement date and start date for retirement benefits.
The retirement date for teachers of public schools in Vietnam is the last day of the month in which one reaches the full retirement age as prescribed.
Will teachers retiring early due to downsizing in Vietnam be subject to pension rate reduction?
Under point a, clause 1, Article 5 of Decree 29/2023/ND-CP regarding early retirement:
Early retirement
1. Displaced employees who are 2 to 5 years younger than the statutory retirement age as prescribed in Appendix II issued together with Decree No. 135/2020/ND-CP dated November 18, 2020 on retirement age (hereinafter referred to as Decree No. 135/2020/ND-CP) and have paid social insurance premiums for at least 20 years, and have worked in heavy, dangerous or hazardous industries on the list released by the Ministry of Labor, War Invalids and Social Affairs for full 15 years; or have worked for in severely disadvantaged areas for at least 15 years, on the list released by the Ministry of Labor, War Invalids and Social Affairs, including the working time in areas with region-based allowances of at least 0.7 before January 1, 2021, may benefit from the following welfares, besides pension policies under laws on social insurance:
a) Do not have pensions deducted because of early retirement;
b) Receive 03-month average salary for each early retirement year compared to the statutory retirement age stated in Appendix II issued together with Decree No. 135/2020/ND-CP ;
c) Receive 05-month average salary for the first 20 working years with full payment of compulsory social insurance premiums. From the 21st working years onwards, each working year with social insurance premiums paid shall be granted a half of 01-month salary.

Thus, teachers retiring early due to downsizing in Vietnam will not be subject to pension rate reduction if they meet the conditions:
- Be 2 to 5 years younger than the statutory retirement age as prescribed.
- Have paid social insurance premiums for at least 20 years, and have worked in heavy, dangerous or hazardous industries on the list released by the Ministry of Labor, War Invalids and Social Affairs for full 15 years; or have worked for in severely disadvantaged areas for at least 15 years, on the list released by the Ministry of Labor, War Invalids and Social Affairs, including the working time in areas with region-based allowances of at least 0.7 before January 1, 2021.
