What are the responsibilities of extra class centers in Vietnam?

Under Article 14 of Circular 29/2024/TT-BGDDT, the responsibilities of extra class centers in Vietnam are stipulated as follows:

(1) Implement the regulations on extra classes outlined in Circular 29/2024/TT-BGDDT and other relevant legal provisions.

(2) Manage and ensure the quality of extra classes and the rights of students and tutors; manage and use fees for extra classes in accordance with regulations.

(3) Manage and retain records of the organization of extra classes as required.

(4) Report and explain the implementation of the regulations in Circular 29/2024/TT-BGDDT and related legal provisions to competent authorities upon request.

(5) Accept and handle feedback, suggestions, and requests from students and their parents regarding extra classes before and during implementation.

What are the regulatory requirements for establishment of extra class centers in Vietnam?

According to Clause 1, Article 6 of Circular 29/2024/TT-BGDDT, the regulatory requirements for establishment of extra class centers in Vietnam include:

+ Register the business in accordance with the law;

+ Publicly disclose on web portals or post at the location of the extra class center regarding the subjects for which extra class is organized; the duration of extra class for each subject according to each grade; the location, form, and schedule of extra class sessions; the list of teachers of extra classes and the fees for extra class before enrolling students in extra classes (according to Form No. 02 in the Appendix attached to Circular 29/2024/TT-BGDDT.

- Teachers of external extra classes must ensure good moral character and possess the professional capacity suitable for the subject they are extra class.

- Teachers teaching at schools who wish to provide external extra classes must report to the Principal or Director or head of the school (hereinafter referred to as the Principal) regarding the subject, location, form, and schedule of their extra classes.

Note: This report is made according to Form No. 03 accompanying Circular 29/2024/TT-BGDDT.

Furthermore, since the operation of extra class centers is an unconditioned business line, it must meet the conditions for establishing an enterprise when opening a center:

- Conditions regarding business lines;

- Conditions regarding the location of the headquarters;

- Conditions regarding the entity establishing the center;

- Conditions regarding the legal representative;

- Conditions regarding the name of the extra class center;

What are the rules of external extra classes in Vietnam?

Under Article 3 of Circular 29/2024/TT-BGDDT (effective from February 14, 2025), the rules of extra classes are as follows:

- Extra classes are only organized when students wish to attend extra classes and have consent from parents or guardians (hereinafter collectively referred to as parents). Schools, organizations, or individuals organizing extra classes are not allowed to force students into extra classes in any manner.

- The content of extra classes must not contravene the regulations of Vietnamese law, and must not bear biases regarding race, religion, occupation, gender, or social position. There shall be no omission of educational content according to the school's educational plan to include in extra class sessions.

- The purpose of extra classes must contribute to the development of students' qualities and abilities; it must not affect the organization of the school’s education program or the implementation of the subject curriculum by teachers.

- The duration, time, location, and form of organizing extra class sessions must be suitable to the psychological and physical condition of the age group, ensuring students' health; must comply with the legal regulations about working hours, overtime, and other relevant legal regulations concerning security, order, safety, environmental hygiene, and fire prevention in the area where extra classes are held.

What is the maximum fee rate for extra classes at extra class centers in Vietnam?

According to Article 7 of Circular 29/2024/TT-BGDDT (effective from February 14, 2025), the regulations on fees for extra classes are as follows:

Collection and Management of fees for extra classes

1. The funding for organizing internal extra classes uses state budget sources and other lawful funding sources in accordance with legal regulations.

2. The fees for external extra classes shall follow the agreement between the student's parents or guardians with the extra class center.

3. The collection, management, and use of fees for extra classes shall follow financial laws, budget regulations, property management, accounting, taxes, and other relevant legal regulations.

The above regulations do not stipulate a maximum or minimum fee rate for external extra classes. The fees for external extra classes shall follow the agreement between the student's parents or guardians with the extra class center.
