Proposal: Teachers in Vietnam will report to the Principal if they teach outside of school
According to Article 5 of the Draft Circular stipulating regulations on extra tutoring and learning, the provisions for extra tutoring and learning outside of school are as follows:
Extra Tutoring and Learning Outside of School
- Organizations or individuals conducting business in extra tutoring and learning outside of school (hereafter referred to as extra tutoring centers) must meet the following requirements:
a) Register a business according to legal regulations.
b) Publicize the subjects offered for extra tutoring and learning; the duration of extra tutoring for each subject according to different grade levels; the location, and time of extra tutoring sessions; the list of extra tutoring teachers and the tuition fees before enrolling students for extra tutoring classes.
- Teachers (including Vice Principals or deputies of the head) who are working and receiving salaries from the budget of public general educational institutions or continuous educational institutions participating in extra tutoring outside of school must meet the following requirements:
a) Report to the Principal about the subject, location, and time of participation in extra tutoring and commit to the Principal to complete the assigned tasks and not violate the regulations in Article 3 of this Circular.
b) In cases where a teacher's extra tutoring class outside of school includes students from the class the teacher is currently teaching in the school, the teacher must report and list those students (name of student; class they are attending in the school) to the Principal and commit not to use any form of coercion to force students to take extra classes.
- Principals participating in extra tutoring outside of school must report and obtain approval from the Head of the Department of Education and Training (for secondary school level), the Director of the Department of Education and Training (for high school level).
The Draft Circular stipulating regulations on extra tutoring and learning has proposed that public school teachers who participate in extra tutoring outside of school must report to the Principal about the subject, location, and time of participation in extra tutoring, and commit to the Principal to complete the assigned tasks and not violate the principles of extra tutoring and learning regulations.
If a teacher has students in the extra tutoring class who are from the class the teacher is currently teaching in the school, the teacher must report, list those students to the Principal and commit not to use any form of coercion to force students to take extra classes.

Are university educational institutions in Vietnam allowed to organize tutoring in general education programs?
Based on Clause 3, Article 3 of Circular 17/2012/TT-BGDDT, extra tutoring is not allowed in following cases:
Cases Where Extra Tutoring is Not Allowed
- No extra tutoring is allowed for students who attend school sessions arranged by the school twice per day.
- No extra tutoring is allowed for primary school students, except in cases of training in the arts, physical education, sports, and life skills.
3. University educational institutions, colleges, professional secondary schools, and vocational schools are not allowed to organize extra tutoring in general education programs.
- For teachers receiving salaries from the budget of public service providers:
a) They are not allowed to organize extra tutoring outside of school but may participate in extra tutoring outside of school.
b) They are not allowed to tutor outside of school students they teach in regular school sessions without the permission of the head of the teacher's management agency.
Thus, university educational institutions are not allowed to organize extra tutoring for contents under the general education program.
Do students in Vietnam need to write an application for extra tutoring within the school?
Based on Clause 1, Article 5 of Circular 17/2012/TT-BGDDT:
Organizing Extra Tutoring and Learning Within the School
- Students wishing to attend extra tutoring must write an application for extra tutoring and send it to the school; parents or guardians (hereafter referred to as parents) of students wishing to attend extra tutoring must directly sign and commit with the school about extra tutoring and learning in the application for extra tutoring and bear responsibility for fulfilling the commitment.
- The Principal receives students' applications for extra tutoring, organizes groupings of students according to their academic abilities, assigns teachers to the respective subjects, and organizes extra tutoring based on the groups of students' academic abilities.
- Teachers wishing to participate in extra tutoring must fill out an application; in the application, they commit to the school to complete all the general tasks of a teacher and other tasks assigned by the school, and strictly adhere to the regulations on extra tutoring within the school.
- The Principal reviews the list of extra tutoring teachers, assigns teachers to participate in extra tutoring, schedules extra tutoring sessions in accordance with the students' academic abilities.
Thus, if students wish to attend extra tutoring within the school, they must write an application for extra tutoring and send it to the school.
Parents or guardians wishing to apply for extra tutoring must directly sign and commit with the school about extra tutoring and learning in the application and bear responsibility for fulfilling the commitment.
