Proposal: Organizations and individuals engaged in private tutoring outside of school in Vietnam are required to register their business
According to Article 5 of the Draft Circular on Regulations for Private Tutoring, the regulations forprivate tutoring outside of school are as follows:
Private Tutoring Outside of School
- Organizations or individuals engaged in private tutoring outside of school (hereinafter referred to as private tutoring facilities) must comply with the following requirements:
a) Register the business according to the provisions of law.
b) Publicize the subjects organized for private tutoring, the duration of each subject by grade level, the location and timing of extra lessons, the list of tutoring teachers, and the tuition fees before enrolling students for extra lessons.
- Teachers (including the Vice Principal or deputy head) working and receiving salaries from the payroll fund of public general education or continuing education institutions participating in private tutoring outside of school must comply with the following requirements:
a) Report to the Principal regarding the subject, location, and timing of the private tutoring, and commit to the Principal to complete the assigned tasks without violating the regulations stipulated in Article 3 of this Circular.
b) In cases where the teacher's extra class outside of school includes students they are teaching in school, they must report and list those students (including their names and current class in school) to the Principal and commit not to coerce any student into extra classes.
- Principals participating in private tutoring outside of school must report and obtain consent from the Head of the Department of Education and Training (for secondary schools) and the Director of the Department of Education and Training (for high schools).
The Draft Circular on Regulations for Private Tutoring proposes that organizations and individuals engaged in private tutoring outside of school must register their business according to the law. This is one of the new points in the Draft Circular on Regulations for Private Tutoring.
Previously, Article 6 of Circular 17/2012/TT-BGDDT regulated private tutoring (invalidated by Article 1 of Decision 2499/QD-BGDDT 2019), including:
Organizations or individuals licensed to organize private tutoring:
- Commit to the commune-level People's Committee where the extra educational service is located, to comply with regulations onprivate tutoring outside of school and to maintain order, security, and environmental sanitation at the private tutoring location.
- Publicize at the private tutoring location, both before and during the private tutoring:
+ License for organizing private tutoring;
+ List of extra-teaching personnel;
+ Private tutoring timetable;
+ Tuition fees.

In what cases is private tutoring prohibited in Vietnam?
Based on Article 4 of Circular 17/2012/TT-BGDDT, the following cases are prohibited for private tutoring:
- No private tutoring for students who are already receiving two sessions of school a day.
- No private tutoring for primary students, except for those seeking additional training in arts, sports, or life skills.
- Higher education institutions, colleges, intermediate vocational schools, and vocational training centers are not to organize private tutoring of contents based on the general education program.
- For teachers receiving salaries from the public service provider's payroll:
+ They may not organize private tutoring outside of school but may participate in such activities outside of their primary teaching duties;
+ They may not provide private tutoring to students they are teaching without the approval of their supervisory authority.
What are regulations on organizing private tutoring within schools in Vietnam?
According to Article 5 of Circular 17/2012/TT-BGDDT, the regulations on organizing private tutoring within schools are as follows:
- Students wishing to partake in extra lessons must submit an application for extra classes to the school; parents or guardians (hereinafter collectively referred to as parents) directly sign and make commitments with the school regarding private tutoring and submit it along with the application, taking responsibility for compliance.
- School Principals shall receive applications for extra lessons from students, organize student groups based on academic ability, assign teachers for each subject, and organize extra classes according to student ability groups.
- Teachers wishing to provide extra lessons must file an application for private tutoring; in the application, they must commit to the school to fulfill all teaching duties according to general regulations and other tasks assigned by the school, while strictly adhering to private tutoring regulations within the school.
- School Principals shall review and approve the list of tutoring teachers, assign said teachers, and arrange a suitable timetable for extra lessons based on the students' academic abilities.
