Are visiting teachers entitled to a day off on Vietnam Teachers' Day - November 20?

According to Article 7 of the Regulations on policies for visiting teachers in educational institutions issued with Circular 44/2011/TT-BGDDT which stipulates visiting contracts:

Visiting contract

1. For visiting teachers who are officials and public employees

a) The visiting contract is a task-based contract. The conclusion, implementation, modification, and termination of the visiting contract shall be carried out in accordance with the regulations in Section 7 Chapter XVII of the Civil Code. Labor contracts are not implemented for visiting activities of officials and public employees.

b) The visiting contract must include a clause in which the visiting teacher commits to ensuring the completion of duties at their workplace.

2. For visiting teachers who are not officials and public employees

a) For the activities mentioned in points a, b, c, d, clause 1 Article 2 of this Regulation, the visiting contract is a labor contract as stipulated by the Labor Code. The conclusion, implementation, termination of the visiting contract, complaints, denouncements, and resolution of complaints, denouncements shall follow the regulations of labor law.

b) For visiting activities mentioned in point đ clause 1 Article 2 of this Regulation, the visiting contract is a task-based contract. The conclusion, implementation, modification, and termination of the visiting contract shall be carried out in accordance with the regulations in Section 7 Chapter XVII of the Civil Code.

According to Article 112 of the Labor Code 2019, it stipulates as follows:

Public holidays

1. Employees shall be entitled to fully paid days off on the following public holidays:

a) Gregorian Calendar New Year Holiday: 01 day (the 1st of January of the Gregorian calendar);

b) Lunar New Year Holidays: 05 days;

c) Victory Day: 01 day (the 30th of April of the Gregorian calendar);

d) International Labor Day: 01 day (the 1st of May of the Gregorian calendar);

dd) National Day: 02 days (the 2nd of September of the Gregorian calendar and the previous or next day);

e) Hung Kings Commemoration Day: 01 day (the 10th of the third month of the Lunar calendar).

Additionally, in Circular 26-TT-1982:

3. On November 20, schools can rearrange teaching and learning activities so that teachers have a day off and participate in school and local activities.

Each school should have enriching, concise activities such as introducing the teaching profession's traditions; recounting the most profound memories of teaching; reading excerpts from students' letters to the school; inviting students with significant achievements in production, study, work, and combat to speak at the school; seminars on the honor and responsibility of teachers; promoting love for teaching and children for pedagogical students; organizing cultural, arts, and sports activities ...

Schools need to summarize competitions and launch new competition campaigns to ensure the tasks set out in the first semester are well executed.

In recent years, localities have gained experience in organizing November 20. Strictly adhering to the decision of the Council of Ministers to ensure the significance of Vietnam Teachers' Day, localities should implement this circular and apply good experiences to organize November 20 annually in a solemn, practical manner, avoiding ostentation and causing inconvenience to students and their parents.

Thus, although November 20 is not a public holiday as specified in the Labor Code 2019, on this day, schools can rearrange teaching and learning activities so that visiting teachers can have a day off and participate in school and local activities.

What are the rights of visiting teachers in Vietnam?

Under Article 9 of the Regulations on policies for visiting teachers in educational institutions issued with Circular 44/2011/TT-BGDDT, the rights of visiting teachers  in Vietnam are as follows:

Rights of visiting teachers

1. Be entitled to remuneration, salary, and benefits as agreed in the visiting contract and according to the law.

2. Participate in professional and occupational activities, receive professional training, and be facilitated for scientific research at the visiting institution, be considered for awards, and be recognized for meeting standards and appointed to titles such as Professor, Associate Professor as per the law.

3. Be provided, supported with necessary materials, equipment, and means by the visiting institution; be evaluated, classified, and rewarded if achievements are made in educational and training activities according to the law.

Thus, the rights of visiting teachers include:

- Be entitled to remuneration, salary, and benefits as agreed in the visiting contract and according to the law.

- Participate in professional and occupational activities, receive professional training, and be facilitated for scientific research at the visiting institution, be considered for awards, and be recognized for meeting standards and appointed to titles such as Professor, or Associate Professor as per the law.

- Be provided, supported with necessary materials, equipment, and means by the visiting institution; be evaluated, classified, and rewarded if achievements are made in educational and training activities according to the law.
