Penalties for violations against the regulations on rearview mirrors of motorcycles under Decree 168

Under Article 14 of Decree 168/2024/ND-CP:

Penalties and point deductions on driving licenses for operators of motorcycles, mopeds, and similar vehicles committing violations against the regulations on vehicle conditions when participating in traffic

1. A fine ranging from 400,000 VND to 600,000 VND for any of the following violations:

a) Operating a vehicle without a horn; license plate light; brake light; left-side rear view mirror of the operator, or having them but not functional;

b) Operating a vehicle without a signal light or having them but not functional;

c) Operating a vehicle without near, far headlights or having them but not functional, not according to design standards;

d) Operating a vehicle without a braking system or having them but not functional, not ensuring technical standards;

dd) Operating a vehicle with a rear-facing headlight.

Thus, an operator of a motorcycle without a left mirror or with a non-standard and non-functional left mirror will be fined from 400,000 VND to 600,000 VND.

According to point a, clause 2, Article 13 of Decree 168/2024/ND-CP:

Penalties and point deductions on driving licenses for operators of cars (including trailers or semi-trailers), motorized four-wheel passenger vehicles, motorized four-wheel cargo vehicles, and similar vehicles committing violations against the regulations on vehicle conditions when participating in traffic

2. A fine ranging from 400,000 VND to 600,000 VND for any of the following violations:

a) Operating a vehicle without sufficient headlights, license plate light, brake light, signal light, windshield wipers, rear view mirror, seat belt, escape tools, fire equipment, air pressure gauge, speedometer, or having them but not functional, not according to design standards (for vehicle types required to have such equipment), excluding violations stipulated at point h, clause 3, Article 20, point d, clause 4, Article 26 of this Decree;

Thus, an operator of a car without a rearview mirror or with a non-standard and non-functional rearview mirror will be fined from 400,000 VND to 600,000 VND.

Apart form fines, the car operator is required to install fully standard, technically safe equipment as stipulated.

What motorcycles can students in Vietnam operate?

According to Article 59 of the Traffic Order and Road Traffic Safety Law 2024:

Age and health requirements of vehicle operators participating in road traffic

1. Age requirements of drivers, operators of heavy-duty vehicles are as follows:

a) People of at least 16 years of age may operate mopeds;

b) People of at least 18 years of age may apply for A1, A, B1, B, C1 driver license and certificate of road traffic law trainings in order to operate heavy-duty vehicles in road traffic;

c) People of at least 21 years of age may apply for C and BE driver license;

d) People of at least 24 years of age may apply for D1, D2, C1E, and CE driver license;

dd) People of at least 27 years of age may apply for D, D1E, D2E, and DE driver license;

e) Operators of passenger motor vehicles (including buses) with a seating capacity of more than 29 people (excluding the driver’s seat), passenger sleeper motor vehicles must not be older than 57 in case of male operators and 55 in case of female operators.

Students aged 16 or older can operate mopeds (vehicles with a design speed not exceeding 50 km/h; if driven by an internal combustion engine, the displacement or equivalent capacity does not exceed 50 cm3; if driven by an electric motor, the motor power does not exceed 4 kW).

Students aged 18 or older can be issued a driving license and can operate vehicles corresponding to that license.

What are the regulations on educating regulations of the law pertaining to road traffic order and safety in Vietnam?

Under Article 6 of the Traffic Order and Road Traffic Safety Law 2024, regulations on educating regulations of the law pertaining to road traffic order and safety in Vietnam are as follows:

- Educate children in preschools, students of formal education institutions, vocational education and training facilities on regulations of the law pertaining to road traffic order and safety.

- Traffic police forces are responsible for taking charge, cooperating with authorities governing upper-secondary schools, vocational education and training facilities in providing guidelines on safe motorbike operation for the students.

- The Ministry of Education and Training and Ministry of Labor - War Invalids and Social Affairs shall, within their tasks and powers, take charge and cooperate with the Ministry of Public Security, relevant ministerial agencies in developing, integrating, and incorporating regulations of the law pertaining to road traffic order and safety to education program in preschools, formal education institutions, vocational education and training facilities in a manner appropriate to education levels and majors.
